JAKARTA (MKRI) — In Decision No. 62/PUU-XXII/2024, the Constitutional Court decided that the provision on the threshold for proposing presidential tickets (presidential threshold) under Article 222 of Law No. 7 of 2017 on General Elections (Election Law) is unconstitutional. Therefore, the Court through Chief Justice Suhartoyo rendered petition No. 129/PUU-XXI/2023 to have lost its object.
At the ruling hearing, Chief Justice Suhartoyo stated that the petition submitted by advocate Gugum Ridho Putra shared the concern about the implementation of democratic rights in proposing presidential tickets.
“Therefore, based on the procedural law, which is the guideline for the Court in examining and adjudicating cases, it is not possible for a norm that has been declared unconstitutional to be declared so again. With regard to this matter, without disregarding the assessment in response to the substance of the petition, [the Court has] no other choice but to declare [the petition] having lost its object,” said Chief Justice Suhartoyo in the plenary courtroom on Thursday, January 1, 2025.

At the preliminary hearing, the Petitioner argued that Article 222 of the Election Law was contrary to the provisions of Article 1 paragraph (2), Article 6A paragraphs (1), (2), (3), (4) and (5), and Article 28D paragraph (1) of the 1945 Constitution. He argued that Article 222 had resulted in legal uncertainty because it could potentially lead to an overly dominant coalition that would result in only one or two presidential tickets.
