Lack of C-Forms in Mamberamo Raya Governor Election Questioned

JAKARTA (MKRI) — Ever Mudumi-Mada Marlince Rumaikewi have filed a petition challenging the 2024 Mamberamo regent election results to the Constitutional Court (MK) on Monday, December 16, 2024. Through legal counsel La Ode M. Rusliadi Suhi, the regent-vice regent candidates 3 requested that the Court disregard the provision in Article 158 of Law No. 10 of 2016 on the Second Amendment to Law No. 1 of 2015 on the Election of Governors, Regents, and Mayors into Law (Pilkada Law). They alleged that in the process organized by the Respondent (KPU/General Elections Commission), including verification, there had been many violations and negligence.

“The Respondent did not implement properly [Constitutional Court] Decision No. 60/PUU-XXII/2024 on the requirements for non-party candidates. This harmed [a Petitioner] who is currently an incumbent vice regent who seek election as regent in this 2024 regional election. During the Mamberamo Raya voting, the c-result forms were not used properly. Many polling stations used white boards, which cannot be categorized as authentic evidence. These findings have disadvantaged [the Petitioners],” Rusliadi said.

In the petition, the Petitioners revealed that the KPU had announced the election results on Thursday, December 12 through Decree No. 250 of 2024, in which they stated that the Petitioners had earned 2,874 out of 21,040 valid votes in the region.

Before taking this to the Constitutional Court, they had made a report to the DKPP (Election Organizer Ethics Council) of the violations. They had also asked Bawaslu (Elections Supervisory Body) to decide on the report of violations. The three-day deadline to file a petition to the Constitutional Court, they asserted, is insufficient for finding and collecting evidence of the violations.

The list of the 2024 regional election result dispute petitions on the Court’s website showed that until 18:45 WIB on Monday, December 16, 287 petitions have been lodged, with 138 filed online through SIMPEL, while the other 149 were lodged on site. Out of them, 16 petitions challenge the governor election, 222 were on the regent election, and 49 were on the mayor election.
