JAKARTA, HUMAS MKRI - Law students from Universitas Katolik Parahyangan (FH Unpar) visited the Constitutional Court (MK) on Monday (18/11/2024). This visit was part of their Constitutional Court Procedural Law course. The group was welcomed by Junior Expert Legal Analyst of the Constitutional Court, Ditya Zuliana, in the Court’s Delegation Room.

In her presentation, Ditya Zuliana outlined the establishment of the Constitutional Court in 2003. Prior to the reform era, Indonesia lacked a dedicated institution with the authority to review laws against the constitution. The 1998 reform movement called for significant changes to the state system, including reforms in law and human rights, which ultimately led to the formation of the Court as an independent body tasked with safeguarding the Constitution.

Ditya further discussed the Court's authority as stipulated in Article 24C of the 1945 Constitution. In addition to this constitutional provision, the duties and authority of the Constitutional Court are also governed by Law Number 24 of 2003 on the Constitutional Court and Law Number 48 of 2009 on judicial power, particularly Article 29, paragraph (1).

Subsequently, Ditya elaborated on the election results dispute cases. She explained that the submission of a dispute petition is subject to a strict deadline. Furthermore, the Court allows petitioners to complete or revise their petitions in accordance with technical guidelines. Meanwhile, the Elections Commission (KPU), as the respondent, is required to provide comprehensive evidence. Failure to submit complete evidence may be regarded as negligence on the part of the election organizer.

Ditya also highlighted that the Petitioners’ submissions, including both the initial and revised petitions, can be accessed on the Constitutional Court's official website, mkri.id. "The Respondent's responses and all related documents are also available on the MKRI page," she explained to the 36 students from FH Unpar.
