Maintaining Solidarity to 2024 Regional Election Results Disputes

BOGOR (MKRI) — Constitutional Court (MK) carried out various preparations to resolve the Dispute over Regional Head Election Results (PHPKada) 2024. One of which, MK conducted coaching clinic on the 2024 regional election results disputes for substitute registrars at the Pancasila and Constitution Education Center (Pusdik) Cisarua, Bogor, West Java Province, for three days on November 7-9, 2024.

The Chief Justice Suhartoyo, the Deputy Chief Justice Saldi Isra, along with other Constitutional Justices guide the substitute registrar of the Constitutional Court. After Suhartoyo kicked off the activity on Thursday (7/11/2024), the Justices stated an overview as well as their expectation in resolving the 2024 PHPKada dispute. On the next day, Friday (8/11/2024), reviviewing applications, drafting decision, both the cases that were past the deadline or did not comply with the legal standing, or any dispute with further proof or examination were held. Constitutional Justices and the substitute registrar evaluated handling of the 2024 Legislative General Election Results Dispute (PHPU) case as reference material for handling the upcoming 2024/2025 PHPKada.

The findings of the problems in handling the PHPU were previously discussed and the solutions were formulated accordingly. The activity was held in three panels, directly accompanied by constitutional justices respectively. The results of the discussion from each panel were directly discussed in a plenary session to convey the issues. "Findings emerged that may need to be aligned in the perceptions of each panel which may become a reference for the Court," said Suhartoyo.

The findings mentioned are related to the field of administration and registration (adminreg), for instance, consultation services that provide good services and are to the point on the substance of the consultation align with procedural law. In addition, the findings related to the application review, such as paying attention to the case number as there will be cases registered in 2024 using Roman numerals XXII and cases registered in 2025 using Roman numerals XXIII as well as anticipating applications submitted other than from candidate pairs or observers. The findings of the substance of the case application are unable to be revealed and this will remain to be discussed further in the Judges' Deliberation Meeting (RPH). For example, regarding the template for the decision to be accepted to reach uniformity. 

The Coaching Clinic was officially closed on Saturday (11/9/2024) by Deputy Chief Justice Saldi Isra. Saldi hopes that all Constitutional Court employees will remain solid to maintain the good image of the Court in the public ahead of and during the PHPKada period. "The great improvement of the Court image is our testament to maintain and improve that through resolving disputes over the results of future regional elections. Therefore, we hope for our solidarity so nothing will happen that could threaten the Court image in the future," said Saldi. 

For information, the Court predicts that there will be approximately 324 cases registered regarding the results of the gubernatorial, regental, and mayoral elections from 545 regions (59.45 percent) in 2024. This assumption is based on the ratio of head election cases in 2017 which reached 59.41 percent. Meanwhile, the 545 regions consist of 37 provinces, 415 regencies, and 39 cities that will simultaneously hold their respective regional head elections.
