BANGKOK (MKRI) — Chief Justice Suhartoyo and the MKRI (Constitutional Court of the Republic of Indonesia) delegation attended the Sixth Congress of the Association of Asian Constitutional Courts and Equivalent Institutions (AACC) on “The Constitutional Courts and Equivalent Institutions in Strengthening Constitutional Justice for Sustainable Society” hosted by the Constitutional Court of the Kingdom of Thailand in Bangkok, Thailand on Wednesday to Thursday, September 18-19, 2024.
The AACC Congress was officially opened on Wednesday, September 18 by Atthaniti Disatha-amnarj, advisor to the King of Thailand. Fifteen members and three guest delegations—the Venice Commission, the Conference on Constitutional Jurisdiction of Africa (CCJA), and the The Iberoamerican Conference of Constitutional Justice (Conferencia Iberoamericana de Justicia Constitucional or CIJC).
The Congress consisted of two series of events: conference for exchanging experience and ideas between constitutional justices, and a Board of Members Meeting (BoMM) limited to AACC members to discuss important issues relating to the management of the association and the finalization of the Bangkok Declaration as the output of the Congress.
At the conference at Athenee Hotel in Bangkok, Chief Justice Suhartoyo delivered a presentation on “The Role of the Constitutional Court of the Republic of Indonesia in Upholding the Principles of Sustainable Development” in the first session. He explained Case No. 35/PUU-XXI/2023, where the Court asserted that natural resources are the gift from the Almighty God that serve as pillars of the nation’s sovereignty. The Constitutional Court believes that isles within the Indonesian territory and its coastal areas must be preserved for current and future generations.
Chief Justice Suhartoyo added that the management of isles and coastal areas must meet cumulative requirements as stipulated in the Law on the Management of Coastal Zones and Small Islands, i.e. the obligation to meet environmental management requirements; to pay attention to the ability and sustainability of the local water system, and to use environmentally-friendly technologies; and to comply with statutory provisions relating to the management of small islands and surrounding waters.
“The realization of people’s welfare is highly dependent on the preservation of natural resources and healthy ecosystems, so it is important to maintain sustainable development that is fair and environmentally friendly,” he concluded.
The Chief Justice and the MKRI delegation were welcomed by the President of the Constitutional Court of Thailand and President of the AACC, Nakharin Mektairat, as well as the Deputy Ambassador of the Republic of Indonesia to the Kingdom of Thailand, Fuad Adriansyah.
