KPU Insists Re-recapitulation in Cilincing Followed Court Ruling

JAKARTA (MKRI) — The General Elections Commission (KPU) as respondent in case No. 289-01-05-11/PHPU.DPR-DPRD-XXII/2024 refuted the Petitioner’s claim that the repeat recapitulation it had carried out for the DKI Jakarta Provincial DPRD election for Jakarta 2 electoral district had passed the deadline the Constitutional Court (MK) had set in a previous election results dispute case. It asserted that the repeat recapitulation in Cilincing Subdistrict had started on June 23, 2024, thus meeting the Court’s deadline.

“In the event that a condition outside of the control and/or ability of the DKI Jakarta Provincial KPU and the North Jakarta City KPU that led to the repeat recapitulation not completing within schedule,” said legal counsel Ali Nurdin at a hearing to present the Respondent’s response and testimonies of the Relevant Party and the Elections Supervisory Body (Bawaslu) on Tuesday, August 13, 2024.

The KPU asserted that the Petitioner’s claim of overrun repeat recapitulation at 33 polling stations was inaccurate and legally groundless since it did not relate to the virtue of votes nor there was any loss and significance to the vote acquisition or the number of seats earned by the National Democratic Party (NasDem) as petitioner in this case.

The Respondent explained that on June 23 the North Jakarta City KPU had held a plenary repeat recapitulation meeting at the subdistrict level in Cilincing Subdistrict of North Jakarta City to follow up on the Constitutional Court Decision No. 09-01-14-11/PHPU.DPR-DPRD-XXII/2024, which ordered it to repeat the recapitulation of votes at 233 polling stations in seven villages in Cilincing Subdistrict. Aside from political party witnesses and election observers, Bawaslu personnel also attended the meeting.

The meeting had been scheduled for 07:00 WIB but before it was opened, NasDem witnesses asked that ballot boxes or containers from the villages be checked. They also question the C-result forms inside the containers, not inside the ballot boxes. The region’s KPU then made an explanation based on a letter by the Central KPU.

In response to the objection, the North Jakarta City Bawaslu recommended that the meeting be continued. It was then started at 14:30 WIB or seven hours late from schedule. The meeting was divided into three panels.

However, on the second day, there was a slight delay of the repeat recapitulation in panel 3 to find the missing C-result form from TPS 51 of Marunda Village, which had been slipped into the container of West Semper Village. Until 23:59 WIB, repeat recapitulation in nine polling stations had to be finished, while that in thirty others were postponed.

The Petitioner’s witnesses asked that the repeat recapitulation be halted and the North Jakarta City Bawaslu did not made any recommendation to continue it. Consequently, the recapitulation meeting on panel 3 was suspended. The city’s KPU then waited for a directive of the DKI Jakarta Provincial KPU.

Based on a letter by the Central KPU, the North Jakarta City KPU notified all party witnesses and the city’s Bawaslu to continue the repeat recapitulation plenary meeting on June 26 at 09:00 WIB. The recapitulation was done on 30 polling stations in Sukapura Village and 3 in West Semper Village, which was completed on June 27 at 04:00 WIB.

The KPU claimed that the meeting for the repeat recapitulation of 233 polling stations in Cilincing Subdistrict had been completed without any issue. No one had raised an objection, including NasDem witnesses. In conclusion, everyone had accepted the vote acquisition at all of those polling stations.

The KPU said the plenary meeting for repeat recapitulation of North Jakarta City had taken place on June 26 under the supervision of the city’s Bawaslu. Then the provincial plenary took place on June 29 at the DKI Jakarta Provincial KPU office. Witnesses of all the political party contesting in the 2024 election were in attendance.

NasDem Asks for Revote at 34 Polling Stations in Jakarta 2

The National Democratic Party (NasDem) has filed an election results dispute (PHPU) petition challenging the DKI Jakarta Provincial DPRD election in Jakarta 2 electoral district to the Constitutional Court (MK). The party believes the repeat recapitulation by the General Elections Commission (KPU) had been carried out past the Court-ordered deadline.

The KPU certified 72,819 votes for NasDem and 24,999 for the Democratic Party. The Petitioner could not yet confirm its correct votes due to issues at 34 polling stations (TPS) after the Constitutional Court Decision No. 09-01-14-11/PHPU.DPR-DPRD-XXII/2024 on June 10. However, the Petitioner claimed that a margin of 728 votes had benefitted Democrat.

The Petitioner explained that on June 23 the KPU had certified a repeat recapitulation by comparing the C-result forms and the subdistrict D-result forms at 233 polling stations in seven villages in Cilincing Subdistrict, which the North Jakarta City Bawaslu, the Petitioner’s witnesses, and witnesses of the other political parties attended.

The Court ordered the North Jakarta City KPU to repeat the recapitulation at said polling stations within 15 days since the verdict was pronounced. The Petitioner interpreted this that the repeat recapitulation must have been completed by Tuesday, June 25 at 14:51 WIB.

However, the Petitioner revealed, the KPU had continued the recapitulation until Wednesday, June 26, which was past the Court-ordered deadline.

In its petitum, NasDem asked the Court to annul the KPU Decree No. 1050 of 2024, announced on July 28 at 17:44 WIB, as it pertains to the results of the DKI Jakarta Provincial DPRD election for Jakarta 2 electoral district. It also asked that a revote be done at 34 polling stations in West Semper, Sukapura, and Marunda Villages.
