JAKARTA (MKRI) — Through his legal counsels Raka Gani Pissani and Yunico Syahrir, Erwin Edison attended the judicial review hearing of Article 33 paragraph (2) letter c, Article 47, and Article 49 paragraph (1) letter a of Law No. 23 of 2019 on the National Resource Management for State Defense (PSDN Law) on Tuesday, July 16, 2024. However, at the petition revision hearing for case No. 42/PUU-XXII/2024, he withdrew his petition.

“In response to this Petition, the Court has received a withdrawal letter dated July 16, 2024, signed by the Petitioner and his legal counsels. Since this petition has been withdrawn, we will first report it to the Justices’ Deliberation Meeting (RPH), consisting of 9 judges, regarding the withdrawal of this petition. Furthermore, the withdrawal follow-up will be discussed and notified by the Registrar’s Office,” said Justice Arsul Sani, who chaired the hearing accompanied by Justice Anwar Usman and Justice Enny Nurbaningsih at the Plenary Courtroom.

At the preliminary hearing on Wednesday, July 3, Erwin Edison, an advocate, asserted that Article 33 paragraph (2) of the PSDN Law has restricted citizens from participating in state defense through being military reserves in terms of age. The Petitioner is within productive age (36 years old), and thus should be able to join the selection of military reserve and basic military training. In addition, Article 47 and Article 49 paragraph (1) letter a restrict registration into military reserves until up to 48 years of age. The Petitioner believes that those a little over that age limit are still capable, both physically and mentally, of fighting against military and non-military threats.
