Court Convenes to Draft Regulation on Regional Election Dispute

TANGERANG (MKRI) – The Constitutional Court (MK) held a meeting on “Drafting of Constitutional Court’s Regulations (PMK) on Procedures for the 2024 Governors, Regents, and Mayors Elections Dispute, as well as PMK on the Organizational Structure and Work Procedures of the Registrar's Office” in Episode Hotel, Tangerang, on Thursday, July 11, 2024. The meeting was organized by the Legal Affairs and Registrar’s Administration Bureau (HAK) for three days, Thursday to Saturday, July 11–13, 2024.

The meeting was attended by Chief Justice Suhartoyo, Deputy Chief Justice Saldi Isra, Secretary-General Heru Setiawan, and Registrar Muhidin. Chief Justice Suhartoyo hoped this meeting could provide insights and discussions that would be brought to the Justices’ deliberation meetings (RPH). Especially those related to the drafting of the PMK regarding procedural law of regional elections disputes, and the Organizational Structure and Work Procedure (SOTK) of the Registrar’s Office.

In his remarks, Secretary-General Heru Setiawan delivered his report on this meeting. He said the urgency of holding this meeting was to prepare a draft of PMK before further discussion with all constitutional justices at the end of this month.

“So, here, everyone will prepare drafts of SOTK, and regional elections dispute settlement regulation, which will be discussed at Justice’s deliberation meetings on July 25-28, 2024, in Bandung,” he explained.

He revealed that the meeting participants will receive guidance from the Chief and Deputy Chief Justice. On the next day, Friday, July 12, 2024, the meeting discussed SOTK and PMK on the regional election dispute settlement led by the Registrar. “And this event will be closed on Saturday, July 13, 2024,” He concluded.

Regional Elections Stages

On the same day, the Court presented a speaker from the General Election Commission (KPU), Romi Maulana, who explained the stages and schedules of the election. Starting from updating and compiling the voters list to the voting.

“Currently, it is scheduled to verify the candidacy of individuals who will participate in the Pilkada. Afterwards, the campaign schedule runs from September 25 to November 23, 2024. Followed by voting for the regional head election on November 27, 2024, where based on the KPU schedule, the recapitulation results hopefully can be completed within 20 days, or until December 16, 2024.” Romi explained.

He also conveyed several suggestions related to the PMK on procedural law of dispute on election results. “We just want to provide suggestions to the Court related to the physical document of evidence that is uncertain of the file size, how big it is. On whether it is allowed to have a video conference hearing at the Respondent's office or a place provided by the KPU. And the last one is related to the schedule for submitting petition copies and submitting the Respondent's response.” he concluded.
