JAKARTA (MKRI) — The Constitutional Court (MK) held the second judicial review hearing of Article 299 paragraph (1) of Law No. 7 of 2017 on General Elections (Election Law) on Monday, July 1, 2024. The petition No. 37/PUU-XXII/2024 was filed by Mohamad Ansyariyanto Taliki, an advocate.

The petition revision hearing for the case tool place in the plenary courtroom with Constitutional Justices Daniel Yusmic P. Foekh, Arsul Sani, and Ridwan Mansyur presiding. The Petitioner, who attended the hearing virtually, stated that he had requested the retraction of the petition through the Court’s summons officer.

“The reason is that there is a trial in Makassar, so the schedules clash. So [the petition] to the Constitutional Court is retracted. The request letter will be sent later since there is another trial at (another) court in Makassar,” said the Petitioner emphasizing the reason to retract the petition.

At the preliminary hearing on Monday, March 18, the Petitioner stressed that Article 299 paragraph (1) of the Election Law is in violation of Article 6A paragraph (1) and Article 28D paragraph (1) of the 1945 Constitution. He said the president and vice president could campaign without taking leave of absence. He claimed national media do not provide any information or announcement on the president and vice president’s leave during campaign. Thus, the president/vice president receive state facilities while campaigning for their next election. Therefore, the Petitioner said, the president/vice president should announce their leave during campaign for the sake of public information transparency.
