JAKARTA, (MKRI) — The Constitutional Court (MK) has instructed the General Elections Commission (KPU) (Respondent) to re-examine the C-result forms (plano) within 15 days from the announcement of this ruling for the vote acquisition in the electoral district Jember 1. This verdict was delivered at a ruling hearing on the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election result dispute for case No. 118-01-14-15/PHPU.DPR-DPRD-XXII/2024, petitioned by the Democratic Party, on Monday June 10, 2024.

Constitutional Justice Ridwan Mansyur, delivering the Court’s legal considerations, specified that a re-examination must be conducted at TPS (polling stations) 10, 18, 37, 40, 41, and 43 in Jember Kidul Village; TPS 16, 21,22, 23, 28, 43 of Kepatihan Village; TPS 1, 3, 7, 10, and 12 of Mangli Village; and  TPS 22 of Sempursari Village, all within Kaliwates Subdistrict. This re-examination will involve comparing the C-result forms with the D-result forms from the Kaliwates subdistrict election committee (PPK) to identify and correct any discrepancies.

This step was taken due to the objections raised by the Petitioner (Democratic Party) to Kaliwates PPK and Jember Regency KPU, as well as the Petitioner’s report to Bawaslu (Elections Supervisory Body) of Jember Regency, on the alleged counting errors by the KPU. As a result, a comparison of the C-result and D-result forms is necessary to correct any writing or recapitulation errors.

“[The Court] orders the recount of votes for political parties and DPRD candidates in electoral district Jember 1; annuls the KPU Decree No. 360 of 2024 on the vote count of NasDem for DPRD Jember in Jember 1; and instructs the KPU to reexamine the C-result forms and compare it with the D-result forms from the Kaliwates PPK, Jember Regency, to correct any errors found within 15 days from this ruling,” stated Chief Justice Suhartoyo.

At the preliminary hearing, the Democratic Party claimed discrepancies in the vote count for DPR, Provincial and Regency/City DPRD seats in East Java Province. The vote count for NasDem according to the Respondent (KPU) and the Petitioner was 12,748 and 12,648, respectively. For the Democratic Party, both parties reported 12,672 votes. This resulted in a 48-vote difference between the two parties. This occurred at TPS 10, 18, 37, 40, 41, and 43 of Jember Kidul Village, Kaliwates Subdistrict. Due to the Respondent’s miscalculation, the Petitioner filed an objection to the subdistrict election committee (PPK) on March 2, and to Bawaslu Jember on March 4.
