JAKARTA (MKRI) — The Constitutional Court (MK) rejected the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute petition for case No. 196-01-03-22/PHPU.DPR-DPRD-XXII/2024 on Monday, June 10, 2024. The case was petitioned by the Democratic Party for the electoral district of South Kalimantan 1.

“Relating to the petition’s subject matter, [the Court] rejects the Petitioner’s petition in its entirety,” said Chief Justice Suhartoyo delivering the verdict.

In its legal considerations, delivered by Constitutional Justice Daniel Yusmic P. Foekh, the Court stated that upon further examination of the Petitioner’s arguments of an alleged increase of 626 votes for the National Mandate Party (PAN) as the Related Party in Aluh-Aluh Subdistrict in the a quo petition, the testimony of the Petitioner’s witnesses did not correspond with the allegation.

“Regarding the allegation of inflated votes for the Relevant Party in Cintapuri Darussalam and Mataraman Subdistricts in Banjar Regency, the Court found no evidence from the Petitioner regarding a report to the Bawaslu (Elections Supervisory Body) concerning the allegation. Additionally, based on the testimony of the Respondent’s witness, Suprat, there were no objections from political party witnesses during the recapitulation at the Cintapuri Darussalam Subdistrict level. Furthermore, according to another witness for the Respondent, Sugeng Riyadi, there were no objections during the recapitulation process, including by the Petitioner, in the Mataraman Subdistrict,” Justice Foekh explained.

No Objection by Petitioner’s Witnesses

Similarly, regarding the allegation of inflated votes for the Relevant Party in Rantau Badauh Subdistrict in Barito Kuala Regency, there were no objections raised by the Petitioner during the recapitulation at the district, regency, provincial, or national levels, nor was there any report to the Barito Kuala Regency Bawaslu. Moreover, during the Court hearing on May 29, the Petitioner did not present any witnesses to further substantiate the validity of their allegation.

Even if the margin in votes for the Relevant Party based on Bawaslu’s corrective decision amounted to 93 votes, combined with the vote transfer in the Aluh-Aluh Subdistrict according to the Petitioner’s witness’ testimony, totaling 634 votes, it was found that this total did not affect the votes for both the Petitioner and the Relevant Party in determining the seats of DPR members for electoral district South Kalimantan I. In this case, the Petitioner obtained 89,979 votes, while the Relevant Party received 94,602 votes based on the national-level recapitulation.

“Based on those explanations, the Petitioner’s allegations are legally unfounded,” Justice Foekh clarified.

In its petition, the Democratic Party questioned the deduction of one vote for the Petitioner and the inflation of 6,066 votes for PAN in South Kalimantan I for the acquisition of DPR seats. The discrepancy in votes between the Respondent’s and Petitioner’s versions stemmed from the increase in votes in 7 subdistricts in Banjar Regency and 1 subdistrict in Barito Kuala Regency, favoring PAN and disadvantaging the Democratic Party, thus affecting the results of the DPR election in South Kalimantan 1.

Therefore, in its petitum, the Petitioner requested the annulment of General Elections Commission (KPU) Decree No. 360 of 2024 for the entire South Kalimantan I. The Petitioner also requested the Court to determine the vote acquisition for South Kalimantan I as follows: 89,980 votes for the Democratic Party and 88,536 votes for PAN.
