Court Rejects NasDem’s Petition for East Java VIII

JAKARTA (MKRI) — The Constitutional Court (MK) rejected the entire petition by NasDem (National Democratic Party) for electoral district East Java VIII. The ruling hearing for Decision No. 102-01-05-15/ PHPU.DPR-DPRD-XXII/2024 on the DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute was held on Monday, June 10, 2024.

Deputy Chief Justice Saldi Isra read out the legal considerations, where the Court stated it had found an error during the counting of ballots at the polling station level by the polling station working committee (KPPS), particularly in the summation of the vote conversion of candidates and parties. As a result, it looked as if something was missed and not counted at all. He continued that this error had been corrected at the subdistrict recapitulation as stated in the D-result form without directly changing the numbers on the C-result form. As a result, there was a misunderstanding as if there was an addition and/or reduction of votes during the subdistrict recapitulation.

“Corrections to the results of polling station recapitulation at a higher level (subdistrict) are allowed. Such misunderstandings could not have occurred if election participants had optimized witnesses at the polling station or subdistrict level. So, the Petitioner’s arguments regarding the inflation of votes for PDI-P (Indonesian Democratic Party of Struggle) and the reduction of the Petitioner’s votes cannot be proven or cannot convince the Court, so they must be declared unreasonable according to law,” said Justice Saldi.

Thus, the Court rejected the exceptions by the Respondent and Relevant Party and rejected the Petitioner’s petition in its entirety.

At the preliminary hearing on Monday, April 29, the Petitioner requested the Court to annul the KPU Decree No. 360 of 2024 as it pertains to the electoral district of East Java VIII. The Petitioner and Respondent’s versions of the Petitioner’s vote count was 327,271 and 326,578 while PDI-P’s was 327,259 and 327,921 respectively.

According to the Petitioner, this discrepancy occurred due to data collection errors of the C-result form and D-result form at the subdistrict level between NasDem and PDI-P at the polling stations in the electoral district. Due to the vote reduction, the Petitioner requested the Court to determine the correct results of the DPR election for the electoral district East Java VIII, where NasDem obtained 327,271 votes and PDI-P obtained 327,259 votes.
