JAKARTA (MKRI) — Bawaslu (Elections Supervisory Body) Decision No. 001/LP/ADM.PL/BWSL.KAB/16.28/III/2024 has not been implemented by the Respondent (KPU/General Elections Commission). Therefore, in order to obtain legal certainty and ensure the number of votes for each political party, the Respondent must recount the ballots at 15 polling stations (TPS) in Proppo and Palengaan Subdistricts, Pamekasan Regency.
This legal consideration was delivered by the Deputy Chief Justice Saldi Isra for the National Mandate Party’s (PAN) petition at the ruling hearing on the 2024 DPR (House of Representatives) and Provincial and Regency/City DPRD (Regional Legislative Council) election results dispute (PHPU) on Monday, June 10, 2024.
In the considerations for Decision No. 261-01-12-15/PHPU.DPR-DPRD-XXII/2024, the Court mentioned that it had compared the subdistrict C-result and D-result forms of 15 polling stations in Proppo and Palengaan Subdistricts because there was a discrepancy between PAN’s votes at TPS (polling station) 4 of Tattangoh Village, Proppo Subdistrict and the Democratic Party’s votes at TPS 22, 25, and 26 of Laragan Badung Village; TPS 19 of Palengaan Dajah Village; TPS 4, 6, 14, 16, 23, and 27 of Banyupelle Village; TPS 903, 904, 905, and 906 of Potoan Laok Village, Palengaan Subdistrict which were listed on the C-result forms with the votes listed in the subdistrict D-result forms.
“Therefore, according to the Court, the Petitioner’s petition for the Pamekasan Regency DPRD election in electoral district (dapil) Pamekasan 2 is legally reasonable in part,” said Deputy Chief Justice Saldi.

In the petition, the Petitioner (PAN) stated that it received 114,583 votes, while Gerindra received 340,285 votes. Meanwhile, the KPU stated that PAN received 112,515 votes and Gerindra received 342,288 votes in East Java IV. According to the Petitioner, the difference was because the recapitulation at the subdistrict level did not comply with the DPR C-result form and the C-result copy following Article 16 paragraph (1) letter b of the KPU Regulation No. 5 of 2024. The recapitulation of votes at the subdistrict to the provincial/national levels must have been inaccurate because the vote count was not based on the DPR C-result form and the C-result copy.
Meanwhile, for Pamekasan 2, the Petitioner claimed that PAN received 6,508 votes and the Democratic Party received 19,481 votes. However, KPU stated that PAN received 6,498 votes and the Democratic Party received 19,911 votes. Recapitulation at the subdistrict level, which did not adhere with the DPR C-result form and the C-result copy, occurred at 35 polling stations in seven villages of Proppo and Palengaan Subdistricts, Pamekasan Regency.
