JAKARTA (MKRI) — The admission of KPPS (polling station working committee) 04 members of Karangturi that the ballot box seals were opened to input valid and invalid ballots that had been left outside was supported by the Respondent’s (KPU) witnesses, who stated that the condition of the DPR ballots outside the sealed ballot boxes from the polling station to the subdistrict had not changed. Bawaslu (Elections Supervisory Body) even stated that the ballots and ballot boxes remained intact at the polling station until they were moved to the village hall.
These were the Court’s legal considerations delivered at a ruling hearing on the dispute over the results of the election of members of the DPR (House of Representatives) and Provincial and Regency/City DPRD (Regional Legislative Council) on Friday, June 7, 2024. Constitutional Justice Arsul Sani read out the legal considerations on PPP’s (United Development Party) arguments.
Justice Ridwan further stated that after the Court examined the evidence and listened to witness testimonies, it believed that there were no facts that could prove a violation of the opening of the sealed ballot boxes at TPS 4 of Karangturi Village, Lasem Subdistrict, Rembang Regency. The Petitioner’s arguments on the DPR election in electoral district Central Java III, he continued, were unclear. Meanwhile, the Petitioner’s arguments regarding the Rembang Regency DPRD for electoral district Rembang 2 were legally ungrounded.
“[The Court] declares the verdict No. 44-01-13-13/PS/PHPU.DPR-DPRD-XXII/2024, which was pronounced in a plenary courtroom publicly on May 21, 2024, valid; grants the Respondent’s exception related to the vagueness of the petition concerning the DPR in Central Java III; declares the petition of the Petitioner concerning the DPR election in Central Java III inadmissible; rejects the petition of the Petitioner concerning the Rembang Regency DPRD election in Rembang II,” said Chief Justice Suhartoyo reading out the verdict.

At the preliminary hearing on Monday, April 29, the Petitioner requested the annulment of the General Elections Commission (KPU) Decree No. 360 of 2024 concerning the results of the DPR election in electoral district Central Java III and the Rembang Regency DPRD election in electoral district Rembang II. The Petitioner alleged an illegal transfer of the Petitioner’s votes for the DPR election in Central Java III to the Change Indonesia Guardian Party (Garuda).
The Petitioner further alleged violations by election organizers due to the excessive use of ballot papers in the DPRD election of electoral district Rembang Regency 2. For instance, there was unauthorized opening of ballot boxes at TPS 4 of Karangturi Village, Lasem Subdistrict, without the preparation of a special incident report and without political party witnesses present.
As a result, a revote was carried out. However, it affected the seat allocation in Rembang 2, where the National Democratic Party (NasDem), which obtained the last seat, earned 4,437 votes whereas PPP acquired 4,414 votes, resulting in a vote margin of 23 for Rembang 2. Therefore, the Petitioner requests that the Court order the KPU to certify the correct vote count result according to the Petitioner and Garuda for the 2024 DPR election in Central Java III, where PPP acquired 145,008 votes and Garuda acquired 99 votes.
