NasDem’s Votes at TPS 14 Bumirejo Yogyakarta Changed

JAKARTA (MKRI) — The Constitutional Court (MK) held a follow-up hearing on the Election Results Dispute for 2024 DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) (PHPU DPR / DPRD) filed by the NasDem, on Thursday, May 30, 2024. The agenda of the hearing is to hear the statements of witnesses/experts, examine and certify additional evidence.

In Case No. 200-01-05-14/ PHPU.DPR-DPRD-XXII/2024, the parties heard their statements include witnesses from the Petitioner, Sunarto, Riyanto, Sutomo, Rahmatul Azhari, Gunawan Nur Cahyo. While the Respondent (KPU) presented witnesses including Grant Muthiah, Noor Aan Muhlishoh, Muryono Puja Rasa Satuhu. Then the Relevant Party (Golkar) presented witnesses Slamet Santoso, Andi Nur Widayat Joko Yuwono, Aji Yudistira Hendrawan.

In the Panel 2 hearing presided over by Deputy Chief Justice Saldi Isra (chair panel) with the Constitutional Justices Ridwan Mansyur and Arsul Sani, Sunarto as PAN's mandated witness at polling station 01 in Lendah sub-district explained that during the recapitulation at the sub-district level, it was found that at polling station 14 Bumirejo there was a change in NasDem's votes from 61 votes to 4 votes. “I held the C.Hasil and I listened and noticed there was a margin and then I showed it to the NasDem witness. There was no adjustment or correction. I signed after the plenary and other witnesses including the NasDem witness also signed,” said Sunarto.

Riyanto a voter of TPS 02 Siturejo Village and sub-district witness coordinator from PKB gave his statement when attending the plenary found that at TPS 14 Bumirejo the NasDem Party's vote was written as 61 votes, after being in the sub-district it became 4 votes. Furthermore, Sutomo as a witness from the NasDem at polling station 29 Taman Martani said that during the vote count, he saw errors such as voters entering their ballot papers in different places. So physically this is enough to tire the witnesses and choose not to sign the final results when determining the results.

“So we prefer not to sign and we focus on maintaining the votes of each party and NasDem's votes are not a problem where there are 12 votes there,” Sutomo explained.

Gunawan Nur Cahyo, a mandated witness from the NasDem in Kalasan Subdistrict, said that the recapitulation process dragged on for 11 days. This happened because the Sub District Election Committee (PPK) officers from the sub-district were too tired and there were too many polling stations in Purwomartani Village. “I was informed by the NasDem regional witness that there were problems with the vote acquisition, I finally just paid attention to C. The results for polling station 29 Taman Martani were correct from Golkar's 10 votes to 14 votes,” explained Gunawan.

Complete Recapitulation Attended

Noor Aan Muhlishoh, a member of the Sleman Regency KPU, explained that the district level recapitulation meeting was held on February 28, 2024 and was fully attended by all interested parties. During the read-out of the recapitulation results, each sub-district always provides an opportunity for witnesses to deliver statements.

“There were 16 out of 18 election participants who signed all the recapitulation results and the NasDem was present on behalf of Slamet Widodo. There are no recommendations and notes of objection,” Muhlishoh said.

In the Preliminary Hearing on Monday, April 29, 2024, the Petitioner requested that the Court annul the General Election Commission Decision No. 360 of 2024 for Yogyakarta 6. The comparison of the vote acquisition according to the Respondent and the Petitioner, Golkar's vote acquisition by the Respondent and the Petitioner was 20,281 and 19,826 votes, while NasDem's vote acquisition according to the Respondent and the Petitioner was 19,861, so that between the two there was a margin of 455 votes that occurred in the recapitulation stick at the sub-district level. The distribution of vote inflation was found in Purwomartani Village, Tirtomartani Village, Tamanmartani Village, and Sekomartani Village.

Based on the entire description, the Petitioner requested that the Court grant the Petitioner's petition in its entirety; and determine the correct vote count according to the Petitioner for filling the Provincial DPRD of Yogyakarta Special Region 6 as follows: NasDem with 19,861 votes and Golkar with 19,826 votes; request the Respondent to carry out a recount of votes at several polling stations.
