Testimonies Reveal Suspected Vote Inflation in NTB's Lembar and Sekotong Subdistricts

JAKARTA (MKRI) – The Constitutional Court (MK) held a follow-up examination hearing for the 2024 legislative election results dispute for case No. 21-02-08-18/PHPU.DPR-DPRD-XXII/2024 petitioned by Abubakar Abdullah, a DPRD (Regional Legislative Council) candidate from the Prosperous Justice Party (PKS). The hearing was to hear testimonies by the Petitioner’s  witnesses namely Saepul Rahman, Muh. Zulmayadi, M. Ahyar and the Respondent’s witnesses namely M. Faizir, Fachrurrozi, and Ahmad Suryandi.

Before the Panel 2, presided over by Deputy Chief Justice Saldi Isra and Constitutional Justices Ridwan Mansyur and Arsul Sani, Saepul Rahman, the coordinator of PKS witnesses in Sekotong Subdistrict, reported that the area comprised 227 polling stations (TPS) and 1 special TPS across 9 villages with a Final Voters List (DPT) of 48,501. The plenary, held from February 17-24, 2024, proceeded smoothly, encountering issues only when the final results were determined.

"The addition/transfer of votes from Candidate Numbers 8 and 7 occurred in 15 TPS in Candi Manik and Taman Baru Villages. In Candi Manik Village, there are 10 TPS: TPS 1, 11, 13, 14, 15, 16, 17, 18, 19, and TPS 20. In Taman Baru Village, there are 5 TPS: TPS 2, 3, 7, 8, and TPS 12. Based on the C- CForm Results, Candidate No. 2 obtained 241 votes, but in the D-Form Results, this number increased to 826 votes," Saepul said.

Then Muh. Zulmayadi as the coordinator of witnesses in Lembar Subdistrict who brought C-Form Results from 167 TPS in the subdistrict explained that the vote acquisition based on C-Form Results for Candidate No.1 was 1,689 votes, Candidate No. 2 was 2,783 votes, and Candidate No. 8 was 442 votes.

“But in the D-Form Results read out by the Subdistrict Election Committee (PPK), Candidate No. 1 received 1,689 votes, Candidate No. 2 received 3,140 votes, and Candidate No.8 received 85 votes. The proof was on the C-results and its recapitulation. I requested that the ballot box be opened to find out where the changes occurred. Previously, if there was a change at the TPS, you could open the ballot box and correct it, but PPK told us to make an incident letter, “said Zulmayadi.

The same statement was also said and confirmed by M. Ahyar as the PKS witness at the regency level. He explained the objections that occurred in Sekotong and Lembar Subdistricts requesting the committees open the ballot boxes, but were not accommodated and the witnesses were asked to write objections on the D-objection.

No Margin in Vote Acquisition

While the General Elections Commission (KPU) as the Respondent in the witness statement on behalf of M. Faizir as PPK denied the testimony of the witnesses who explained the incident of the margin in the vote acquisition. Based on his testimony, during the plenary at the subdistrict level, the data submitted in the KPU’s vote recapitulation information system (Sirekap) was in accordance with what was stated in C-results and there was no difference between the two.

"PKS witnesses did object to the D-results, which had previously been approved by different PKS witnesses. On the same night, the Petitioner requested a re-comparison, but the PPK did not entertain the objection as it had been agreed upon and followed the existing mechanism. After the results were determined, the Petitioner filed an objection. Considering that the D-results had not been signed and the situation was already chaotic due to the masses, we accommodated the objection in the D-objection to avoid any clashes," said Faizir.

During the preliminary hearing on Thursday, May 2, 2024, the Petitioner requested  the Court to annul the KPU Decree No. 360 of 2024 for the electoral district of West Lombok 2. As a result of the decree, the Petitioner's vote acquisition affected the acquisition of seats in the Regency/City DPRD in West Lombok. Regarding several matters of addition and reduction of votes for PKS candidates, namely the Candidate No.2 Hadran Farizal which obtained 3,966 votes according to the Respondent, but the Petitioner claimed it was 3,024 votes, so there was an addition of 942 votes; Candidate No. 7 L. Amrun which obtained 41 votes according to the Respondent, but the Petitioner claimed it was 133 votes, so there was a reduction of 92 votes; Candidate No. 8 Badrun Tammam which obtained 126 votes according to the Respondent, but the Petitioner claimed it was 976, so there was a reduction of 850 votes. Thus, the Petitioner requested the Court to hand down a decree by determining the correct vote acquisition results for the Petitioner in the election of the Regency DPRD candidates from PKS in West Lombok 2,
