JAKARTA (MKRI) — The Constitutional Court (MK) continued the hearing for the 2024 legislative election results dispute by the National Mandate Party (PAN) on Monday, May 27, 2024. In case No. 246-01-12-06/PHPU.DPR-DPRD-XXII/2024, PAN requests the Court to annul the KPU (General Elections Commission) Decree No. 360 of 2024 on the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) election in the electoral districts of Ogan Komering Ilir (OKI) 6 and Lahat 2, South Sumatra Province,.
At the hearing on Panel 3, Constitutional Justices Arief Hidayat, Anwar Usman, and Enny Nurbaningsih heard witness statements and examined and validated additional evidence with the Petitioner (PAN), the Respondent (KPU), and the National Awakening Party (PKB) and the Indonesian Democratic Party of Struggle (PDI-P) as Relevant Parties in attendance.
PAN Lost Votes
Suyadi, the Petitioner’s (PAN) witness, was a PAN witness in Lempuing Subdistrict, Ogan Komering Ilir Regency. He explained the lack of synchronization in the recapitulation across 206 polling stations in 19 villages during the plenary session on February 18-24, 2024.
“During the plenary session regarding TPS 05 of Sukamulya, we raised an objection, but the head of the subdistrict election committee (PPK) and subdistrict election supervisory committee (Panwascam) did not allow us to raise this objection, resulting in the recapitulation being suspended for two hours,” he explained.
Suyadi testified that the PPK and Panwascam’s decision regarding the differences between the C1 and C-Copy forms in 7 villages was to refer to the C1 plano form, and all party representatives agreed with this.
Syarif Hidayat, the second PAN’s mandate witness at the KPU plenary meeting at the regency level said, “At the KPU plenary session on March 4, 2024, PAN through legislative candidate number 6 made a report to Bawaslu because PAN lost 20 votes at TPS 2 and 3 in Tulung Harapan Village, Lempuing Subdistrict. The lost votes occurred because the PPK officers was negligent in inputting data.”
Anton Amery, the Petitioner’s witness at the plenary session in Lempuing Jaya Subdistrict, had discovered irregularities as follows: C1 plano and C1 copy data were not the same, PPK did not allow witnesses to raise objections, an input error by the PPK so PAN experienced a shortfall of 22 votes, and PDI-P’s votes increased by 19.
Then, Aman Supami, PAN’s witness in Lahat 2, testified that because there had been many irregularities, he did not sign the plenary document and he then made a report to Bawaslu.
KPU’s Witnesses
Antoni Ahyar, commissioner in Ogan Komering Ilir Regency, testified that the recapitulation process took place on March 1-4, 2024. In Lempuing and Lempuing Jaya Subdistricts, the recapitulation was carried out on March 2 and there were no objections by the party witnesses.
Objections were raised on the fourth day of the recapitulation when the session was about to close and the document signing would begin. These objections were the same as those submitted by the Petitioner’s witnesses.
Alno Viano Harjanto from the Lempuing Subdistrict PPK, said that the plenary session in Lempuing Subdistrict took place on February 18-25, and there were 11 objections raised by PAN in the recapitulation. Nine of the eleven demands had been corrected at the subdistrict plenary session, while the other two were only discovered after the plenary session at the KPU had finished in Tulung Harapan Village because the data at TPS 2 had not been entered into Sirekap, but instead was entered at another polling station. This problem could not be corrected because it had passed the plenary deadline.
