Gerindra’s Witnesses Reveal Voter Impersonation in Sintang Regency

JAKARTA (MKRI) — The Great Movement Party (Gerindra) as the Petitioner of case No. 284-01-02-20/PHPU.DPR-DPRD-XXII/2024 presented witnesses at a hearing on the Sintang Regency DPRD (Regional Legislative Council) election results dispute (PHPU) for the electoral district of Sintang 5 at a hearing at the Constitutional Court (MK) on Wednesday, May 29, 2024. The witnesses revealed that other people had voted under their names.

Serak, a witness for the Petitioner, who was registered at TPS (polling station) 02 of Deme Village, Ambalau Subdistrict, Sintang Regency, revealed that he had not voted in the 2024 election because he had been at his workplace in Tembiar Hamlet, Tapang Tingang Village, Nanga Taman Subdistrict, Sekadau Regency.

“I did not participate in the general election at TPS 02 of Deme Village, Ambalau Subdistrict, Sintang Regency because I was at my workplace in Sekadau Regency. However, in reality, someone else voted under my name, Your Honors,” he said in front of Chief Justice Suhartoyo and Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on Panel 1 in the plenary courtroom.

Serak found out that someone else had voted under his name when he received a phone call from one of the legislative candidates asking whether he had voted. He also met with a Gerindra member and was shown his name on the voting attendance list at TPS 02 in Deme Village along with his signature. However, Serak emphasized that it was not his signature.

Adrianus Daut and wife Karnaen also claimed not to have come to TPS 02 of Deme Village. However, both their names were on the voting attendance list.

In addition, Yayan Mardianto, a Gerindra mandated witness at the subdistrict to regency level, explained that there were reports of voter impersonation at TPS 02 in Nanga Tekungai Village, Serawal Subdistrict. He said a voter claimed not to have voted but her husband had voted under her name.

“Then the second report was related to a deceased person, Fransiskus H., who was still included in the final voters list and someone else voted under his name,” said Yayan. This was then proven by the death certificate of Fransiskus H. However, Yayan regretted that Bawaslu (Elections Supervisory Body) only sent a warning and removed Fransiskus’ name from the final voters list at TPS 02 of Nanga Tekungai Village.

In the petition, the Petitioner argued that the margin of 13 votes for the Democratic Party’s victory was due to fraud and was in violation of the principles of honest and fair election, especially by the polling station working committee (KPPS) of TPS (polling station) 002 of Nanga Tekungai Village, Serawal Subdistrict, which significantly affected the Petitioner’s votes and seats. It believes 15 ballots were used by ineligible voters, consisting of 1 deceased person, 10 absentees, 2 underage voters, and 2 active voters.

The Petitioner requests that the Court annul the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 nationwide legislative election results on March 20, 2024 in relation to the DPRD election of the electoral district of Sintang 5, West Kalimantan Province. It also requests the Court to declare the accurate vote acquisition: Democratic Party candidate 01 Agustinus Adena with 170 votes from initial 185, making the party’s total votes 4,670. The Petitioner also requests the Court to certify the accurate vote acquisition for political parties and DPRD members of Sintang 5 for Gerindra and the Democratic Party after correction: Gerindra with 4,672 votes and the Democratic Party with 4,670 votes; to order the KPU (Respondent) to hold a revote at TPS 002 of Nanga Tekungai Village, Serawal Subdistrict and TPS 002 of Deme Village, Ambalau Subdistrict for Sintang Regency DPRD.
