JAKARTA (MKRI) — The Constitutional Court held a follow-up hearing on the 2024 DPD (Regional Representatives Council) election dispute results filed by DPD candidate for the electoral district of Maluku Province Nono Sampono on Tuesday, May 28, 2024. At the hearing for Case No. 09-31/PHPU.DPD-XXII/2024, the Petitioner’s legal counsel team made a request to withdraw the case.

“We have received a letter from Elza Syarief Law Firm to withdraw the petition. This withdrawal will be conveyed to the justice deliberation meeting (RPH) and no further evidentiary proceedings will be held. Thus, the Relevant Party and the Respondent have no obligation to present witnesses,” said Deputy Chief Justice Saldi Isra, who presided over the hearing on Panel 2 with Constitutional Justices Ridwan Mansyur and Arsul Sani.

At the preliminary hearing on Tuesday, April 30, the Petitioner requested the annulment of the KPU (General Elections Commission) Decree No. 360 of 2024 on the election of DPD candidates for the electoral district of Maluku Province. Based on the C-1 calculation obtained from the polling stations in the village, the Petitioner only received 806 votes, while DPD candidate Mirati Dewaningsih (Relevant Party) received 1,265 votes, so there was a margin of 459 votes. The Petitioner explained that the total votes for the election of DPD for Maluku Province were 1,035,047 votes. Based on the total votes, the Petitioner received 84,660 votes in all of Maluku Province.

In addition to the vote margin, the Petitioner also argued that there had been a decrease in his votes in the recapitulation of the results at the district level. One of them was in West Seram Regency, where he should have received 2,433 votes, but only 1,804 votes were listed in the recapitulation at the district level, so there was a margin of 629 votes.

Therefore, the Petitioner requests that the Court hand down a decision to stipulate the correct vote acquisition results according to the Petitioner for the election of DPD in the electoral district of Maluku Province where Nono Sampono received 85,713 votes and Mirati Dewaningsih received 85,261 votes; establishing Nono Sampono as the owner of the largest votes at the fourth place in the election of Maluku Province DPD in 2024.
