Analyzing the Recount Process at the Sirimau Subdistrict Level in Ambon

JAKARTA (MKRI) — The Constitutional Court held the hearing  for the 2024 legislative election results dispute, filed by the Great Movement Party (Gerindra), on Tuesday, May 28, 2024. The agenda for the session included hearing testimony from witnesses/experts, examining, and validating additional evidence.

In this session for Case No. 262-01-02-31/PHPU.DPR-DPRD-XXII/2024, parties including witnesses for the Petitioner (Gerindra), namely Sandhy Takka and Soleman Uniwaly, were heard. Meanwhile, the Respondent presented witnesses, including Nurdin Muruapey, M. Fachry Fahreza, Matheos Nanulaitta, and Syahrifudin Bustam.

Before Panel 2 of the hearing, presided over by Deputy Chief Justice Saldi Isra along with Constitutional Justices Ridwan Mansyur and Arsul Sani, Sandhy Takka, acting as a mandated witness and witness coordinator from Gerindra for the PPK, reported an incident that occurred one day before the recapitulation results were finalized in the subdistrict, involving vote inflation for the National Mandate Party (PAN) at TPS 25 Batu Merah where PAN's C.Result showed no votes but D.copy obtained 42 votes. He called for a review at 118 TPS in Ambon 2.

“We also found issues at 9 other TPS with a total of 64 inflated votes. We requested the PPK to match the votes, but the PPK did not address our objections,” Sandhy explained.

Soleman Uniwaly described his special incident notes during the Ambon City KPU recapitulation process, which was suspended twice; initially during the session when there were questions or objections from PKS and Gerindra witnesses, then the Sirimau PPK could not demonstrate the accuracy of its data validity. The session resumed, but little was discussed and was suspended again until 03:00 AM.

“Therefore, the unilateral synchronization by the PPK and KPU without presenting witnesses, we consider this a violation of the rules. We reject the figures stated in the D.Result of PPK Sirimau; for us, it cannot be finalized because it is flawed, and the issues involved 10 TPS,” Soleman clarified.

Results Rectified

Meanwhile, the Respondent’s witness, Nurdin Muruapey, as the Chairman of the PPS along with members, monitored the voting process through to the counting across all 166 Batu Merah TPS. On the 7 TPS alleged by the Petitioner, Nurdin continued, no issues were found, and some witnesses signed the results of the counts held at that time. Regarding TPS 63 and 127 in Batu Merah Village, Nurdin stated the recapitulation began with the presentation of the ballot boxes to the panwascam and the parties involved. This was done to retrieve the C.Results for each election type for counting and to read out the results for each candidate.

“It was found that the PAN candidate received 2 votes on the tally sheet, but ultimately it was recorded as 0 votes. Upon this, the panwascam recommended corrections, and all witnesses accepted the results without objections,” Nurdin elucidated.

At TPS 127, the recapitulation went smoothly as there was no discrepancy in the data from each witness with the C.Result form, and no objections were raised by the witnesses. Next, M. Fachry Fahreza discussed incidents that occurred at TPS 25, 33, and 139 in Batu Merah, and TPS 03 and 09 in Pandan Kasturi.

“At  TPS 33, during the DPRD Regency/City election recapitulation, there was a mistake in recording the valid votes, with the tally for the PAN candidate being 5 but written as 4, which has been corrected. At TPS 139 in Batu Merah, a discrepancy was found in the number of voter data not matching the number of used votes, and this was resolved by correction and all witnesses signed,” Fachry reported.

At the Preliminary Hearing on Tuesday, April 30, 2024, the Petitioner noted a discrepancy of 64 votes with the National Mandate Party (PAN). According to Decision No. 360 of 2024 by the KPU, Gerindra should have received 2,428 votes, while according to the Respondent, PAN received 2,417 votes. The discrepancy between the two political parties resulted from a lack of scrutiny at the plenary recapitulation meeting for Sirimau Subdistrict II in Ambon 2. Thus, a miscalculation occurred that went uncorrected from the inflation of votes with the mode of adding unauthorized PAN votes at 10 TPS in Ambon 2 based on the Model C-Results Copy form not syncing with the vote tally in the Model D Results Copy form at those TPS. The accumulation of these alleged violations led to a miscalculation causing the Petitioner to lose a seat in Ambon District 2 for the Ambon City DPRD.
