JAKARTA, MKRI - The Constitutional Court (MK) held an evidentiary hearing over the 2024 DPRD (Regional Legislative Council) election results dispute for case No. 78-01-04-34/PHPU.DPR-DPRD-XXII/2024. Petitioner's witnesses were present Breser Bauw, Aplonarius Braweri, dan Matheus Anselmus Ohoiledwaren by the Party of Functional Groups (Golkar). Meanwhile, the Respondent presented Alli Idris Kutangkas, Yulius Agustinus Hindom, and M. Makmur Memed Alfajri as witnesses.
In the hearing of Panel 2 led by Deputy Chief Justice Saldi Isra along with Constitutional Justices Ridwan Mansyur and Arsul Sani, Melino Breser Bauw as a Golkar Party Witness explained the process of voting and counting votes at polling station (TPS) 01 Kampung Weriagar. At the TPS there were 140 Final Voters List (DPT) and during the recapitulation the number of voters who exercised their right to vote reached 100%.
"Meanwhile, upon further scrutiny, it was discovered that two voters had passed away, and one voter was of school age. Witnesses communicated on February 14, 2024, to clarify that the Final Voters List (DPT) should not have been 140 but 137, as three voters did not exercise their voting rights," explained Melino.
Aplonarius Braweri as a member of district election committee (PPD) explained about the implementation of the plenary in Weriagar District which only recapitulated the Regency/Provincial DPRD, DPD, and Presidential Election were not conducted.
“On March 8, 2024, a plenary was held in the district and there were changes in the votes for the provincial level for the United Indonesia Party (Perindo), where the C.Results read 49 votes, while in the D.Results it changed to 537 votes. I was called by a Golkar Party candidate to confirm the data,” said Aplonarius.
Matheus Anselmus Ohoiledwaren, a witness from the Golkar Party, explained that during the district recapitulation, Golkar filed an objection because Form D.Hasil had only been distributed. The Golkar Party then had difficulty comparing the data. “Because we don't have a copy of the C. Form Results for the entire Fafurwar and Weriagar Districts so we don't have a comparison of the data,”
Presence Without Signature
Alli Idris Kutangkas, Head of polling station working committee (KPPS) TPS 02 village Weriagar, reported that the number of DPT was 203 with 225 voters. Of the 208 ballots received, 206 ballots were used and 2 ballots were missing. Golkar Party received 50 votes, while Perindo Party received 107 votes.
Yulius Agustinus Hindom, Chairperson of the Weriagar District PPD, explained that the election on February 14, 2024 took place not according to the KPU schedule, finishing late in the afternoon, and the vote count was carried out at night at polling station 01 and polling station 02. Recapitulation was carried out on February 15, in conjunction with the scheduled logistics pick-up, so the counting in the sub-district took place on February 16, 2024 from 13.00 to 18.00 WIT. All parties including the supervisory committee and political party witnesses were present, but did not sign the plenary results.
M. Makmur Memed Alfajri, Chairman of the Teluk Bintuni Regency General Elections Commission (KPU), explained that on February 14, 2024, the voting was held and the logistics had arrived the day before. The plenary results are tiered from the TPS, district, to district level. Weriagar District recapitulation was carried out on February 15, and logistics were received by the Regency KPU on February 17. The results were determined based on the district D.Results, while the C.Results were known after there was an order to open the ballot box from the KPU for evidence to the Court.
In the Preliminary Session on Friday, May 5, 2024, the Golkar Party rejected the results of the vote count recapitulation conducted by the KPU for the West Papua Provincial DPRD West Papua Dapil 3, regarding their votes and Perindo Party. Golkar claims the KPU added 772 votes for Perindo and reduced 11 Golkar votes in Weriagar District. Had this reduction not been made by the Respondent, the Petitioner would have been awarded the 1st and 5th seats in West Papua Dapil 3 for the West Papua Provincial DPRD. For this reason, the Petitioner requests that the Court determine the correct vote acquisition, namely 11,982 votes for Golkar and 3,989 votes for Perindo Party.
