PPP Witness Testifies on Vote Counting in Banten Province

JAKARTA (MKRI) — The Constitutional Court (MK) held an evidentiary hearing on the 2024 legislative election results of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of Banten Province on Monday, May 27, 2024. The Case No. 46-01-17-16/PHPU.DPR-DPRD-XXII/2024 was filed by the United Development Party (PPP), represented by party chairman Muhamad Mardiono and secretary-general Arwani Thomafi.

At the hearing presided over by Chief Justice Suhartoyo and the other constitutional justices, PPP (Petitioner) presented Aat Hidayat, a witness at TPS (polling station) 16 of Unyur Subdistrict, Serang Regency. He explained that the KPU’s (General Elections Commission) vote recapitulation information system (Sirekap) could not receive date and the green color indicator did not appear on Sirekap. “Strangely, green indicators did not appear for the valid votes on Sirekap,” he said.

Then, Aat continued, the total votes were counted manually. He said that after recounting the valid votes to 228 votes, Sirekap became green. “As a witness, [I] complained to the organizers and the complaint was accepted,” he explained.

At the hearing, the KPU as the Respondent presented witnesses, one of which was Darmawan. He explained that voters in the final voters list (DPT) exercised their voting right at TPS 095 of Unyur Village, Serang Subdistrict. Then, he continued, the calculation error of the total valid and invalid ballots on the KPU C-result form and the C-result copy form of the KPU at TPS 095 of Unyur Village had been corrected.

At the preliminary hearing that on April 29, the Petitioner argued that in the electoral districts of Banten I, II, and III, there was a transfer of the Petitioner’s (PPP) votes to Garuda (Indonesian Guard of Change Party): 5,000 votes in Banten I, and 5,450 votes in the Banten II, and 8,150 votes in the Banten III, due to counting errors by the Respondent. For this reason, in its petitum, the Petitioner asks for the annulment of the KPU Decree No. 360 of 2024 in the electoral districts of Banten I, Banten II, and Banten III in Banten Province, for the Serang City DPR for the electoral district of Serang I, and the Tangerang City DPRD for the electoral district of Tangerang 4.
