JAKARTA, MKRI – The Constitutional Court (MK) decided Case No. 176-02-02-10/PHPU.DPR-DPRD-XXII/2024 regarding the Election Results Dispute of the Batam City DPRD for Election District (Dapil) 2. The case was petitioned by the Great Movement Party (Gerindra). According to the Court, the Petitioner was unable to explain in detail the arguments, so that petition was declared vague.

“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom. At Plenary Courtroom, building 1 on Wednesday, May 22, 2024.

Constitutional Justice Daniel Yusmic P. Foekh explained, the petition disputes the difference between the votes obtained by the Petitioner and the Relevant Party of 137 votes. However, in describing the alleged vote counting errors committed by the Respondent, the Petitioner did not include the vote count determined by the Respondent or the correct vote count.

The Petitioner explained that during the recapitulation of vote count results at the sub-district level, the Respondent had a votes purge at TPS 33 Bengkong Indah Village by one vote. Meanwhile, in the sub-district recapitulation, the vote was only 11 votes. After the Court examined the evidence submitted by the Petitioner, the Court could not read the evidence submitted.

The vote purge and inflation of votes argued by the Petitioner is obscure. In addition, the Petitioner’s petitum and posita were inconsistent. The Petitioner argues that it is a political party participating in the election for the Batam City DPRD Dapil 2 election. Meanwhile, in the petitum, the Petitioner requested to cancel KPU Decree No. 360 of 2024 along the Batam City Dapil 2 for the Batam City DPRD election individually.

 

In addition, in the petition's posita, it was argued that there was an inflation of votes. The petitioner requested a re-vote rather than a recount of ballots or at least a comparison of the votes considered to be disadvantaged.

For information, the Petitioner requested the Court to re-voting at TPS 06 Bengkong Indah Village, Bengkong Subdistrict and cancel the General Election Commission(KPU) Decree No. 360 of 2024 concerning the Determination of the General Election Results for Members of the DPR, DPD, DPRD (Provincial / Regency) on Wednesday, March 20, 2024 at 22.19 WIB along the Batam City 2 constituency for the filling of candidates for the Batam City DPRD.
