The Court Issues Ruling on PKN's Petition in North Maluku

JAKARTA (MKRI) — The Constitutional Court delivered an Extract of Ruling No 96-01-09-32/PHPU.DPR-DPRD-XXII/2024 concerning the 2024 legislative election results dispute of Province/Regency filed by the Nusantara Awakening Party (PKN) in several electoral district (dapil) in North Maluku Province. The Court stated, the Petitioner’s petition throughout the legislative election for North Maluku and North Halmahera Regency 1 is inadmissible.

"Adjudicating, before rendering a final decision, the Court stated that the Petitioner's petition throughout the filling of seats for the House of Representatives (DPR RI) North Maluku and the the Regional Legislative Council (DPRD) North Halmahera Regency 1 is inadmissible," stated Chief Justice Suhartoyo during the ruling hearing at the Plenary Courtroom of Building 1 of the Constitutional Court, Jakarta, on Tuesday, May 21, 2024.

Deputy Chief Justice Saldi Isra explained that the Petitioner's petition concerning the filling of seats for the DPR North Maluku Electoral District did not detail how the alleged violations occurred and how these violations affected the Petitioner's vote results. As for the Petitioner's petition regarding the filling of seats for the DPRD of North Halmahera Regency 1, the Court found that the Petitioner included "the general election result dispute for the DPRD of North Maluku Regency Electoral District Halmahera Utara I." Given this fact, the Petitioner's petition became unclear or obscure because, factually, there is no such area as North Maluku Regency. Therefore, the above-mentioned argument does not meet the formal requirements for the PHPU petition and must be declared obscure.

Before rendering a final decision, it is essential for the Court to issue an extract of the ruling stating that the Petitioner's petition regarding the filling of membership for the DPR RI North Maluku and the DPRD of North Halmahera Regency is inadmissible. The aforementioned arguments will not proceed to the evidentiary hearing.

 

Evidentiary Hearing

However, Saldi emphasized that regarding the Petitioner's petition concerning the DPRD of North Maluku Province 1, which is also included in the petition, it will proceed to the evidentiary hearing.
