JAKARTA (MKRI) – The Constitutional Court (MK) approved the withdrawal of a petition for case No. 217-01-13-37/PHPU.DPR-DPRD-XXII/2024 on the 2024 election results dispute. The petition was filed by the Crescent Star Party (PBB) against the dispute over the vote acquisition of Jayawijaya Regency DPRD (Regional Legislative Council) candidates for the electoral districts 1, 2, 3, and 4 was revoked from the Court.
“[The Court] approves the withdrawal of the Petitioner’s petition,” said Chief Justice Suhartoyo at a ruling hearing for 2024 legislative election results dispute in the plenary courtroom on Tuesday, May 21, 2024.
Constitutional Justice Daniel Yusmic P. Foekh explained that the Petitioner submitted a petition to withdraw or revoke this case which was also accompanied by a letter dated May 3, 2024. In essence, the Petitioner conveyed the reason for withdrawing the petition due to the insufficient availability of evidence and witnesses. The Court adjourned the preliminary examination of the case on May 3, 2024.
Based on the justice deliberation meeting, the Court concluded that the petition to withdraw or revoke the case was reasonable according to the law and the Petitioner could not re-file the a quo petition. The Court Justices also ordered the chief registrar to return a copy of the petition file to the Petitioner.
In its petition, the Petitioner argued there was a reduction in PBB votes in Jayawijaya electoral districts of 1, 2, 3, and 4 to appoint the Jayawijaya Regency DPRD candidates. According to the Petitioner, the General Elections Commission (KPU) deliberately reduced PBB votes and transferred them to other parties. (*)
