Petition of NasDem Legislative Candidate for Jakarta 7 Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) decided that the petition of Fenty Lindari Amir Fauzi, a legislative candidate for the DKI Jakarta Provincial DPRD 7 serial number 4 from the NasDem, was dismissed. The Panel of Constitutional Justices declared Case No. 206-02-05-11/PHPU.DPR-DPRD-XXII/2024 invalid because the Petitioner was not serious in filing the Petition. This ruling was delivered by Chief Justice Suhartoyo, on Wednesday, May 22, 2024, in the Plenary Courtroom.

“[The Court] Stated the Petitioner's Petition inadmissible," said Chief Justice Suhartoyo when delivering the decree alongside the other eight constitutional justices.

“In a decision delivered by Constitutional Justice Arief Hidayat, the justice deliberation meeting on May 15, 2024 concluded that the Petitioner’s absence at the panel preliminary hearing without any valid reason despite lawful and proper summons showed that the Petitioner did not file the a quo petition seriously. As such, the Petitioner’s petition must be declared inadmissible,” Justice Arief said.

Based on letters a through g of the legal considerations, Justice Arief continued, the Court believes there was no need to hold another session to hear the responses of the Respondent (General Elections Commission/KPU), the Relevant Party, and Bawaslu (Elections Supervisory Body) since they would be irrelevant. As such, those responses and the evidence were not considered any further.

The Petitioner argued that there were differences in the vote count between the Respondent's data (the General Election Commission) and the data presented by the Petitioner based on copies of C1 in DKI Jakarta 7. According to the Petitioner, the correct vote count for the Petitioner was 19,320 votes, different from the 4,108 votes previously determined by the Respondent. Meanwhile, Wibi Andrino, NasDem legislative candidate number 5, should have obtained 9,002 votes, different from the 23,925 votes previously determined by the Respondent. (*)
