JAKARTA (MKRI) — A ruling hearing was held by the Constitutional Court (MK) on the 2024 election results dispute case No. 187-01-17-02/PHPU.DPR-DPRD-XXII/2024 for North Sumatera Province on Tuesday, May 21, 2024 in the plenary courtroom. This case was filed by the United Development Party (PPP), which disputed votes shifted to the Indonesian Guard of Change Party (Garuda).

“[The Court] adjudicated, relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom alongside the other eight constitutional justices.

In its legal reasoning, the Court declared that the Petitioner’s petition did not meet the qualifications as referred to in Article 75 of the Constitutional Court Law and Article 11 paragraph (2) letter b points 4 and 5 of Constitutional Court Regulation No. 2 of 2023 because it did not clearly and adequately describe the error in the vote count results announced by the Respondent (KPU) and the correct count results according to the Petitioner. Therefore, there was no doubt for the Court to declare that the Respondent’s exception on the petition’s obscurity legally warranted. Thus, according to the Court, the Petitioner’s petition was vague.

At the preliminary hearing, the Petitioner stated that based on the General Elections Commission (KPU) Decree No. 360 of 2024, the Petitioner did not meet the parliamentary threshold requirement of 4%, so there was a difference of 193,088 votes or equivalent to 0.13%. It alleged the vote acquisition of the Petitioner and Garuda in the Respondent’s version and its own version was different, especially in 35 electoral districts spread across 19 provinces, one of which is the transfer of votes in the electoral districts of North Sumatra I, II, and III.
