JAKARTA (MKRI) — The Constitutional Court (MK) ruled Case Number 282-01-05-09/PHPU.DPR-DPRD-XXII/2024 in the Election Dispute (PHPU) for the DPR (House of Representatives) in Bangka Belitung Provinces as inadmissible. The Court deemed the Petitioner, the National Democratic Party (Nasdem), failed to adequately outline the grounds for the loss or increase of votes to the Party of Functional Groups (Golkar).
“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo during the ruling hearing of the 2024 Election Dispute (PHPU) in the Plenary Courtroom, Jakarta, on Wednesday May 22, 2024.
In its legal considerations, delivered by Constitutional Justice M Guntur Hamzah, the Petitioner challenged the alleged widespread irregularities resulting in the invalidation of 41,909 votes across 2,186 polling stations (TPS), thereby alleging a loss of electoral support. The Petitioner asserted that their total rightful vote acquisition should amount to 122,381 votes. However, the Petitioner's petition failed to specify the Petitioner's stipulated vote acquisition as stipulated by the Respondent or as asserted by the Petitioner.
The Petitioner only provided the total number of lost votes across 2,186 TPS. After comparing the Petitioner's vote acquisition with Golkar, the Court could not ascertain the specific TPS where the Petitioner's votes were lost among the 368 villages/sub-districts, 47 districts, and seven regencies/cities anywhere.
"There is no doubt for the Court to declare that both the Respondent's exception and the Relevant Party's exception regarding the Petitioner's obscure petition are grounded in law. Thus, according to the Court, the Petitioner's petition is obscure or obscuur," said Justice Guntur.

Previously, the Petitioner (Nasdem) argued that there is a margin of 35,077 votes with Golkar. Nasdem ranks just below Golkar in the election of members of the DPR for the Bangka Belitung Provinces. The Petitioner is convinced that there were numerous substantial errors in the ballot counting process at the TPS by the Polling Station Working Committee (KPPS), resulting in Nasdem ballots being deemed invalid in 2,186 TPS based on data from the D Results of the DPR Sub-Districts and the D Results of the DPR Districts. As a result, Nasdem lost a total of 41,909 votes.
