JAKARTA (MKRI) — The Constitutional Court read out a decree for the petition by DPRD (Regional Legislative Council) candidate Number 5 for the electoral district of Banyuwangi 1 Bernat Sipahutar from the National Democratic Party (NasDem). The ruling hearing for Decree No. 245-02-05-15/PHPU.DPR-DPRD-XXII/2024 was held on Wednesday, May 22, 2024. Constitutional Justice Arsul Sani read out the decree on this case, stating that the Court had summoned the Petitioner legally and properly, but until the hearing ended the Petitioner was not present without any valid reasons.
Based on this legal fact, at the justice deliberation meeting (RPH) on May 15, the Court concluded that the Petitioner’s absence showed that he was not serious in filing the petition. Thus, his petition must be declared inadmissible. Therefore, for this case, the Court believes there was no need to hold another session to hear the responses of the Respondent (General Elections Commission/KPU), the Relevant Party, and Bawaslu (Elections Supervisory Body) since they would be irrelevant.
“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom.
In his petition, the Petitioner stated that there were several indications of fraud in the process of calculating the vote acquisition for the DPRD election in Banyuwangi Regency 1. When the calculation was carried out in Glagah and Kabat Subdistricts, there were seals on the D1 forms. The results of the subdistrict election committee (PPK) recapitulation were torn. Several political parties even requested that the Banyuwangi Regency Bawaslu conduct a recount based on the C1 forms. In addition, the Petitioner also mentioned that when the vote count was carried out, he had a disputed with NasDem candidate number 1 Zamroni. Based on D1 forms, the Petitioner obtained 505 votes, while the Relevant Party obtained 2,253 votes. However, during the recount, the Petitioner’s votes became 508 and the Relevant Party’s 2,046 votes.
