Dismissal of PKS Candidate's Petition Due to Absence from Preliminary Hearing

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for the election results dispute for Case No. 182-02-08-27/PHPU.DPR-DPRD-XXII/2024 which was petitioned by Sri Rahmi, a DPR (House of Representatives) candidate of South Sulawesi Province Electoral District (dapil) from the Prosperous Justice Party (PKS). The reason is that the Petitioner was absent at the panel preliminary hearing until the hearing in question was adjourned.

“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom on Wednesday, May 22, 2024.

Constitutional Justice Arsul Sani explained that the Court has summoned the Petitioner lawfully and properly with the chief registrar letter dated April 24, 2024 on summons. However, until the hearing in question was adjourned on April 29, 2024, the Petitioner was absent without any valid reason.

Based on the justice deliberation meeting, the Court concluded that the Petitioner’s absence at the panel preliminary hearing without any valid reason despite lawful and proper summons showed that the Petitioner did not file the a quo petition seriously. As such, the Petitioner’s petition must be declared inadmissible and the Court issued a ruling.

“The Court believes there was no need to hold another session to hear the response of the Respondent and the testimony of the Bawaslu (Elections Supervisory Body) since they would be irrelevant,” said Justice Arsul reading the decree.
