JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition of Ronny Bara Pratama, a candidate no. 5 of the Party of Functional Groups (Golkar). Panel of Justices declared the dismissal of Case No. 255-02-04-11/PHPU.DPR-DPRD-XXII/2024 since the Petitioner deemed unserious in filing petition a quo. This adjudication was read by Constitutional Chief Justice Suhartoyo on Wednesday, May 22, 2024 in the Plenary Courtroom, Jakarta.

“[The Court] rules to declare the Petitioner’s petition dismissed,” said Chief Justice Suhartoyo alongside other constitutional justices.

In its legal considerations, delivered by Constitutional Justice Arief Hidayat, the Court asserted that the Deliberation Meeting of Justices on May 15, 2024, concluded the absence of the Petitioner at the Preliminary Examination panel hearing without valid reasons, despite being duly summoned, which reasonably indicates the Petitioner's lack of seriousness in filing the petition a quo. "Hence, the Petitioner's petition must be declared dismissed," said Justice Arief.

Based on the legal considerations outlined in points a through g above, Justice Arief continued, and the Court deemed it unnecessary to hold a hearing to hear the Respondent's Responses, Statements from Relevant Parties, and Testimony from the General Election Supervisory Body (Bawaslu) as they were deemed irrelevant. Consequently, if there were any Respondent's Responses, Statements from Relevant Parties, Testimony from Bawaslu, as well as evidence and other matters submitted to the Court, they were not further considered.

Previously, the Petitioner alleged in his petition that there was a vote margin due to structured, systematic, and massive (TSM) vote migration from the party to legislative candidate no. 10, identified as Dadiyono, at the polling station (TPS) level. According to data from Exhibit C submitted by the Petitioner, Candidate no. 10 in North Petukangan Subdistrict acquired 10,873 votes, while the party acquired 783 votes. In contrast, based on Exhibit D from the Respondent, Dadiyono acquired 4,572 votes, while the party acquired 5,357 votes. There was a difference of 6,299 votes from the party that shifted to No. 10 (Dadiyono).
