JAKARTA (MKRI) — The Constitutional Court (MKRI) declared the petition No. 180-01-14-20/PHPU.DPR-DPRD-XXII/2024 on the 2024 DPRD (Regional Legislative Council) election results dispute of the electoral district 1 of West Kalimantan Province petitioned by the Democratic Party inadmissible. According to the Court, the Democratic Party did not question the vote difference the People’s Conscience Party (Hanura).

“[The Court] adjudicated, relating to exceptions: to grant the Respondent’s and the Relevant Party’s exceptions on the obscurity of the petition; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices in the preliminary courtroom on Tuesday, May 21, 2024.

Constitutional Justice Daniel Yusmic P. Foekh explained that the Petitioner was inconsistent in mentioning the location of the additional votes for the Relevant Party (Hanura). The Petitioner noted that one of the locations was TPS (polling station) 134 of Sungai Jawi Village, West Pontianak Subdistrict, Pontianak City, not “Sungai Jawi Dalam.” Instead, it mentioned “Sungai Jawi Luar.”

Justice Foekh said that petitum 2 was inappropriate because in it the Petitioner requested the annulment of General Elections Commission (KPU) Decree No. 360 of 2024 only for Hanura’s vote acquisition, while petitum 3 mentioned the determination of the correct vote acquisition for the Democratic Party and Hanura. Thus, they contradict. Moreover, the details listed in petitum 2 letters a to g were not expected for the reasons for the petition (posita), which questioned the inflation of the Relevant Party’s votes at TPS 75 of Benua Melayu Darat Village in South Pontianak Subdistrict, TPS 07 of Sungai Beliung Village in West Pontianak Subdistrict, TPS 116 of Sungai Beliung Village in West Pontianak Subdistrict, polling station 134 of Sungai Jawi Dalam Village, West Pontianak Subdistrict, TPS 65 of Batu Layang Village in North Pontianak Subdistrict, and the reduction of the Petitioner’s votes at TPS 80 of Siantan Hulu Village in North Pontianak Subdistrict so that they would not be included in “a. West Kalimantan 1 for the filling of candidates for members of the West Kalimantan Provincial DPRD.”

“Therefore, within reasonable reasoning, such a petitum is unjustified,” Justice Foekh said.

The Petitioner stated that the Respondent (KPU) had inflated votes for Hanura at five polling stations: TPS 75 of Benua Melayu Darat Village in South Pontianak Subdistrict; TPS 07 of Sungai Beliung Village, West Pontianak Subdistrict; TPS 116 of Sungai Beliung Village, West Pontianak Subdistrict; TPS 134 of Sungai Jawi Village, West Pontianak Subdistrict; TPS 65 of Batu Layang Village, North Pontianak Subdistrict; and TPS 80 of Siantan Hulu, North Pontianak Subdistrict. Hanura’s votes should have been 27,924 votes but was determined by the Respondent to be 27,930 votes.

Meanwhile, there was a reduction of one vote for the Democratic Party at TPS 80 of Siantan Hulu Village, North Pontianak Subdistrict, Pontianak City. As a result, its votes amounted to 27,928. The Petitioner had submitted an incident/objection form to the KPU for the DPRD election in West Kalimantan 1.
