Deadline Exceeded, Candidate’s Petition for Papua Pegunungan 2 Inadmissible

JAKARTA (MKRI) - The Constitutional Court (MK) dismissed a petition for the 2024 DPRD (Regional Legislative Council) election results dispute of Papua Pegunungan Province on Wednesday, May 22, 2024 at the plenary courtroom. The case No. 146-02-14-37/PHPU.DPR-DPRD-XXII/2024 was filed by Efraim Jendrik A Wandik, a DPRD candidate from the Democratic Party.

“[The Court] adjudicated, relating to the petition’s subject matter, to rule that the Petitioner’s petition is inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.

He also stated that the Petitioner's petition did not fulfill the formal requirements stipulated in Article 74 paragraph (3) of the Constitutional Court Law, Article 474 paragraph (2) of the Election Law, and Article 7 paragraph (1) of the Constitutional Court Regulation (PMK) No. 2 of 2023. Therefore, the exceptions by the Respondent and Relevant Parties on the Petitioner's Petition has passed the specified time limit are grounded in law. Thus, the Court is of the opinion that the Petitioner's Petition has been filed past the time limit stipulated by the laws and regulations.

According to Chief Justice Suhartoyo, although the Court has the authority to hear the a quo petition, but because the Petition was filed past the time limit stipulated by the laws and regulations, the Respondent's responses and exceptions, the Relevant Party’s and Election Supervisory Body’s (Bawaslu) statements, the Petitioner’s legal standing, the petition’s subject matter, and other matters are not considered any further since they would be irrelevant.

At the preliminary hearing, the Petitioner was a DPRD candidate for the electoral district Papua Pegunungan Province 2 which consists of Lanny Jaya Regency and Papua Pegunungan Province based on the General Election Commission (KPU) Decree No. 1562 of 2023 on the List of Permanent Candidates for the 2024 DPR (House of Representatives) election, the photo and name of the Petitioner were in the attachment.  According to the Petitioner, the margin in vote acquisition above was caused by the loss of the Petitioner's votes totaling 34,511 votes. This happened because the chairman and members of the PPD (district election committee) have transferred the Petitioner's votes from Districts of Prime, Wiringgambut, Nogi, Malagineri, West Wano, Milimbo, Tigime, Dimba, and Gelokbeam to Onies Wenda, a candidate from another party in Wiringgambut District.
