Court Dismisses Gerindra Candidate’s Petition for East Java VIII

JAKARTA (MKRI) — The Constitutional Court handed down a decision on the petition by DPR (House of Representatives) candidate for the electoral district of East Java VIII Sigismond B.W. Notodipuro from the Great Movement Party (Gerindra). The hearing to pronounce Decree No. 235-02-02-15/PHPU.DPR-DPRD-XXII/2024 was held on Wednesday, April 22, 2024. Constitutional Justice Ridwan Mansyur delivered the decree on this case, explaining that the Court had made a legal and proper summons, but until the hearing ended the Petitioner was absent without a valid reason.

Based on the legal fact, at the justice deliberation meeting on May 15, 2024, the constitutional justices concluded that the Petitioner’s absence at the panel preliminary hearing without any valid reason despite lawful and proper summons showed that the Petitioner was not serious in filing the petition. The petition shall therefore be dismissed. Therefore, the Court believes there was no need to hold another session to hear the responses of the Respondent (General Elections Commission/KPU), the Relevant Party, and Bawaslu (Elections Supervisory Body) since they would be irrelevant.

“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom.

In his petition, the Petitioner alleged irregularities had occurred in the 2024 DPR election in East Java VIII at all polling stations. One example was candidate number 10 from the Great Movement Party (Gerindra) should have received more votes and won at all polling stations, but the votes it obtained did not match facts on the ground and were far different from the real results.
