Court Dismissed the DPD of South Papua Petition

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed the petition for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute for case No. 10-35/PHPU.DPD-XXII/2024  on Wednesday, May 22, 2024. The case was petitioned by Simon Petrus Balagaise, a DPRD candidate for the electoral district (Dapil) of South Papua Province. 

“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo in the plenary courtroom.

In its legal considerations, delivered by Constitutional Justice M. Guntur Hamzah, the Court asserts that the Petitioner's petition does not meet the qualifications as intended in Article 75 of the Constitutional Court Law and Article 10 paragraph (2) letter b number 4 and number 5 PMK 3/2023. This is because, in the Petitioner's petition there is an unclear description in the vote counting results announced by the Respondent and the correct counting results according to the Petitioner, and there is a discrepancy between the reasons for the Petition (posita) and the matters requested to the Court (petitum). Therefore, regarding this matter, there is no doubt for the Court to declare the Respondent's exception as far as the petition is concerned.

The Petitioner does not fulfill the formal requirements of the application and the conflict between Posita and Petitum is legally grounded.

"Thus, according to the Court, the Petitioner's petition is obscuur," explained Justice Guntur.

Previously, in the preliminary hearing, the Petitioner expressed objection to systematic and massive structured fraud which qualitatively affected the results of the legislative election. According to the Petitioner, obtained vote as a candidate the DPD (Regional Representatives Council) for the South Papua Province had been harmed and damaged due to the actions and behavior of general election organizers and supervisors, especially at the provincial and district/city levels in the Dapil. The 2024 legislative election in the Dapil South Papua Province will be carried out in a structured, systematic and massive manner both before voting and counting the votes. (*)
