Vague, North Kalimantan DPD Candidate’s Petition Inadmissible

JAKARTA (MKRI) The Constitutional Court (MK) decided that the petition filed by Sri Sulartiningsih, a DPD candidate number 15 from North Kalimantan Province, was inadmissible. The constitutional justices asserted that case No. 08-24/PHPU.DPD-XXII/2024 did not meet the formal requirements of because the petition was unclear or vague. The ruling hearing was held on Tuesday, May 21, 2024 in the plenary courtroom.

“[The Court] adjudicated, relating to exceptions: to grant the Respondent’s exception on the obscurity of the petition, to reject the Respondent’s exception for the rest and remained; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.

According to the Court, although the petition described the difference in votes for two DPD candidates in North Kalimantan Province, the Petitioner did not provide a specific explanation of the polling stations.

Because the Petitioner could not elaborate on the arguments in the petition clearly and nor did she explain the significance of the votes for the two DPD candidates for North Kalimantan Province as argued against the votes obtained by the Petitioner, the petition did not meet the provisions of Article 75 of the Constitutional Court Law and Article 10 paragraph (4) of Constitutional Court Regulation No. 3 of 2023. Therefore, the petition was unclear or vague.

The Petitioner had argued that there was a difference in the vote count determined by the Respondent (KPU) for the Petitioner, Abd. Djali Fatah, and Marthin Billa. According to the Petitioner, Abd. Djali Fatah should have had 3,647 votes, not the 3,649 votes determined by the Respondent; Marthin Billa should have had 5,313 votes, not 5,341 votes. The Petitioner’s votes according to both the Petitioner and the Respondent were 11,871.
