JAKARTA (MKRI) — The Constitutional Court (MK) decided that the petition by National Democratic Party (NasDem) on the 2024 Sorong Regency DPRD (Regional Legislative Council) election results dispute for the electoral district of Sorong 1 was inadmissible. The panel of justices stated that case No. 133-01-05-38/PHPU.DPR-DPRD-XXII/2024 did not meet the formal requirements because it was unclear. The ruling hearing was held on Tuesday, May 21, 2024 in the plenary courtroom.
“[The Court] adjudicated, relating to the objections to reject the Respondent’s objection on the Court’s authority, to grant the Respondent’s objection on the Petitioner’s legal standing, relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo alongside the other constitutional justices.
According to the Court, the Petition was vague because in the petitum, the Petitioner requested the cancellation of the entire determination of the election results in 2024, including that of the president and vice president, DPR, DPD, provincial and regency/city DPRD. The Court asserted that the request in the petitum to cancel the General Elections Commission (KPU) Decree No. 360 of 2024 without including the electoral districts in question was contrary to the Petitioner’s arguments and created a contradiction between the posita and petitum, so what was argued and requested by the Petitioner became unclear.

Muhammad Rizal, the Petitioner’s legal counsel, had argued that there was a difference in the vote count between the National Democratic Party (NasDem) and the Prosperous Justice Party (PKS) in the electoral district of Sorong 1. The petitioner claimed that NasDem should have 1,268 votes, while the Respondent determined 1,280. As for PKS, according to the Petitioner, it should have had 1,105 votes which were then determined by the Respondent to be 1,344 votes.
