Perindo’s Election Dispute Petition for Mimika Dismissed

JAKARTA (MKRI) — The Constitutional Court (MK) handed down Decision No. 32-01-16-36/PHPU.DPR-DPRD-XXII/2024 on the 2024 of House of Representatives (DPR) and Regional Legislative Council (DPRD) election results dispute for the electoral district of Mimika Baru District 3, Mimika Regency, Central Papua Province petitioned by the United Indonesia Party (Perindo). The ruling hearing was presided over by all nine constitutional justices on Tuesday, May 21, 2024 in the plenary courtroom.

“At the previous hearing, it was known that the Court had the authority to hear a quo case, the Petitioner’s petition was submitted within the time period as required by law, and the Petitioner had the legal standing to submit the petition to the Court,” said Justice Anwar Usman reading out the legal considerations.

The petition was vague due to inconsistency between the posita and petitum. The Petitioner also did not explain in detail regarding the addition of votes at each polling station (TPS) in Mimika 3 and the loss of votes for Perindo.

“[The Court] adjudicated, relating to the Respondent’s exception: to grant the exceptions by the Respondent and Relevant Parties I and II on the obscurity of the a quo petition, to reject the exceptions by the Respondent and Relevant Parties I and II for the rest and remainder; relating to the subject subject matter, to declare the Petitioner’s petition inadmissible,” Chief Justice Suhartoyo said.
