PPP’s Petition for Lampung Inadmissible

JAKARTA (MKRI) — The Constitutional Court (MK) decided that the petition by the United Development Party (PPP) for the electoral districts of Lampung I and Lampung II was inadmissible. The constitutional justices stated that case No. 209-01-17-08/PHPU.DPR-DPRD-XXII/2024 did not fulfill the formal requirements since it was unclear or obscure. The ruling hearing was held on Tuesday, May 21, 2024 in the plenary courtroom.

“[The Court] adjudicated, relating to exceptions: to grant the Respondent’s exception on the obscurity of the petition; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo alongside the other constitutional justices.

The Court found that the Petitioner did not clearly describe at which stage the alleged counting error by the Respondent had happened. It also did not explain in detail how its votes were transferred to other political parties. Thus, according to the Court, there was a lack of clarity in the petition, which made it vague.

Previously, the Petitioner had argued that there was a margin in votes between the Petitioner and the Indonesian Guard of Change Party (Garuda) in Lampung I and Lampung II of Lampung Province. According to the Petitioner, Garuda should have obtained 146 votes for Lampung I and 205 votes for Lampung II. However, according to the Respondent, Garuda had obtained 7,161 votes for Lampung I and 6,860 votes for Lampung II. On the other hand, the Petitioner’s votes for Lampung I should have been 61,513 votes and 21,206 votes for Lampung II. However, the Respondent determined 54,498 votes for Lampung I and 14,551 for Lampung II. Thus, there was a margin of 7,015 votes for Lampung I and 6,655 for Lampung II between the Petitioner and Garuda.
