PPP's Election Dispute Petition for Aceh II Inadmissible

JAKARTA (MKRI) — The Constitutional Court (MK) declared the United Development Party’s (PPP) petition on the 2024 Election Dispute (PHPU) for members of DPR (House of Representatives) for electoral district Aceh II as inadmissible. The Panel of Constitutional Justices deemed that Case No. 168-01-17-01/PHPU.DPR-DPRD-XXII/2024 failed to meet the formal requirements for the petition, as it was obscure. The Ruling Hearing was held on Tuesday (5/21/2024) in the Plenary Hearing Room, Building 1, Jakarta.

“[The Court] adjudicated, in the exception, to grant the Respondent’s exception relating to the obscurity of the Petitioner’s petition,” said Constitutional Chief Justice Suhartoyo alongside the other constitutional justices.

The Court stated that the Petitioner's petition did not comply with the provisions in Article 75 of the Court Law, Article 9 paragraph (2) of PMK 2/2023, as well as Article 11 paragraph (2) letter b numbers 4 and 5 of PMK 2/2023. The Petitioner failed to refer to specific evidence in each of the claims in the petition. Consequently, the Petitioner's petition was declared as failed to meet the formal requirements for filing a petition.

"The Court finds that the Petitioner's petition does not comply with the provisions in Article 75 of the Court Law, Article 9 paragraph (2) of PMK 2/2023, and Article 11 paragraph (2) letter b numbers 4 and 5 of PMK 2/2023. The Petitioner's petition did not refer to any specific evidence in each of its claims," stated Constitutional Justice Arief Hidayat while reading the legal considerations.

Previously, through its legal counsel Bakas Manyata, the Petitioner claimed that there were illegal vote transfers from the Petitioner to the Indonesian Guard of Change Party (Garuda) in the election for DPR members in electoral district Aceh II, Aceh Province. According to the Petitioner, there was a discrepancy in the vote acquisition between the Respondent's and the Petitioner's version, particularly in 35 electoral districts across 19 provinces. One of the districts where the vote transfer allegedly occurred was electoral district Aceh II, Aceh Province.
