PDIP Candidate Withdraws Election Dispute Petition for West Papua

JAKARTA (MKRI) — The Constitutional Court (MK) approves the withdrawal of the Election Results Dispute (PHPU) Petition by Legislative Candidate No. 2, Matias Maimura from the Indonesian Democratic Party of Struggle (PDI-P) for the House of Representatives (DPR RI). Deputy Chief Justice Saldi Isra delivered the hearing for Ruling No. 114-02-03-34/PHPU.DPR-DPRD-XXII/2024 during the Ruling Announcement Session on 2024 Election Results Dispute for Members of the House of Representatives and Regional Representative Councils (PHPU DPR and DPRD) on Tuesday, May 21 2024.

The Court revealed it had received the petitioner's application on March 23, 2024. According to Article 39(1) of the Constitutional Court Law and Article 41(1) of Constitutional Court Regulation No. 2 of 2023, a Preliminary Examination Session was scheduled for Friday, May 3, 2024. However, the petitioner did not attend the session, having sent a withdrawal letter and lacking endorsement from the Central Executive Board of PDI-P to submit the petition to the Court.

Based on these legal facts, the Justice Deliberation Meeting (RPH) on May 15, 2024, concluded that the withdrawal of the petition was legally justified. According to Article 24(3) of PMK 2/2023, the Court issued a Ruling. Therefore, it was deemed unnecessary to hold a session to hear the Respondent's Answer, Relevant Party’s Statement, and Bawaslu’s Statement, as they were considered irrelevant.

“[Court] declared the withdrawal of the Petitioner’s petition; [Court] declared the Petitioner's petition in Case No. 114-02-03-34/PHPU.DPR-DPRD-XXII/2024 regarding the cancellation of the General Elections Commission Decision No. 360 of 2024 concerning the 2024 General Election Results for President and Vice-President, Members of the House of Representatives, Regional Representative Council, and Regional House of Representatives on a National Level in the 2024 General Election insofar as the vote acquisition in the West Papua electoral district for the House of Representatives General Election is withdrawn,’ stated Chief Justice Suhartoyo as he read the Ruling in the Plenary Courtroom, Building 1 of the Constitutional Court, Jakarta.

In his petition, the petitioner cited in the Results of the District in Pegunungan Arfak Regency, there was an inflation of 713 votes for Candidate No. 1, Obet Rumbruren. According to the petitioner, this was perpetrated by the Respondent at both the regency and provincial levels. Hence, the petitioner requested the Court to order the General Elections Commission to conduct a re-election for the House of Representatives in West Papua 2 at polling stations (TPS), including TPS 06 and TPS 03 in Kampung Trikora, Kaimana Regency; TPS 04, TPS 09, and TPS 18 in Krooy, Kaimana Regency; TPS 01 in Tanggaromi, Kaimana Regency; all TPS in the District of Yamor, Kaimana Regency; throughout South Manokwari Regency, and throughout Pegunungan Arfak Regency."
