JAKARTA (MKRI) — The Constitutional Court announced Decree No. 39-02-14-01/PHPU.DPR-DPRD-XXII/2024 concerning the 2024 election results dispute for members of legislative election results dispute of Province/Regency. The petition was filed by Nanda Nurkhalis, candidate Number 5 from the Democratic Party for the North Aceh Regency/City Legislative Council (DPRK) in electoral district 4. The ruling hearing was pronounced by nine constitutional justices on Tuesday, May 21, 2024, in the Plenary Courtroom, Building 1 of the Constitutional Court.
The Court had lawfully and appropriately summoned the Petitioner to attend the preliminary examination panel on Tuesday, April 30, 2024, at 08:00 WIB. "The Court had lawfully and appropriately summoned the Petitioner with the chief registrar’s letter No. 107/Sid.Pen/DPRDPRD/Pan.MK/04/2024 dated April 25, 2024, regarding the summons. However, the Petitioner did not attend the hearing without a valid reason," stated Constitutional Justice Enny Nurbaningsih.
According to Article 42 paragraph (2) of Constitutional Court Regulation No. 2 of 2023, "If the Petitioner and/or legal counsel do not attend the preliminary examination without a valid reason, even though they have been lawfully and properly summoned, the Court shall declare the petition dismissed."
The Justice Deliberation Meeting on May 15, 2024, concluded that the Petitioner's absence at the preliminary examination panel without a valid reason, despite proper summons, indicated that the Petitioner was not serious about filing the petition. Therefore, the petition must be declared inadmissible.
