JAKARTA (MKRI) — The Constitutional Court (MK) declared that the petition by Demianus Mazau, an Intan Jaya Regency DPRDD (Regional Legislative Council) candidate number 1from the Indonesian Democratic Party of Struggle (PDI-P) inadmissible (niet ontvankelijke verklaard). The case No. 163-02-03-36/PHPU.DPR-DPRD-XXII/2024 did not meet formal requirements because the Petitioner did not have legal standing to file the petition. The ruling hearing was held on Tuesday, May 21, 2024 in the plenary courtroom.
“[The Court] adjudicated, relating to the objection: to grant the Respondent’s exception on the Petitioner’s legal standing, to reject the Respondent’s objection for the rest and the remainder; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” said Chief Justice alongside the other eight constitutional justices.
“The Petitioner did not mention the approval letter from the political party to file the petition as an individual legislative candidate, in casu the approval of the PDI-P’s central executive board. After the Court examined the Petitioner’s petition file received by the Court along with evidence based on the deed of electronic petition filing certificate (e-AP3), the Petitioner only attached a letter of recommendation from the chairman and secretary of PDI-P’s Intan Jaya branch executive board (DPC), without a letter of recommendation or approval signed by the central executive board’s chairman and secretary-general,” said Constitutional Justice Anwar Usman reading out the legal considerations.

The Petitioner’s legal counsel Regio Alfala Rayandra had argued that there was a significant difference in votes in two districts, which resulted in the loss of 3,879 votes for the Petitioner. The Petitioner alleged that members of the district election committee (PPD) and the Intan Jaya Regency Election Commission (KPUD) of had transferred votes without the knowledge of the community or candidates whose names received the valid votes.
