Nagan Raya DPRK Candidates’ Election Dispute Petition Dismissed

JAKARTA (MKRI) —  The Constitutional Court (MK) delivered a ruling for the 2024 DPR-DPRD (House of Representatives-Regional Legislative Council) election results dispute for case No. 18-02-21-01/PHPU.DPR-DPRD-XXII/2024. The case was petitioned by two Nagan Raya DPRK (Aceh Regency/City Legislative Council) candidates TR Muhibuddin and Abdul Rahman from the Aceh Party. However, at the preliminary hearing on April 30, the Petitioners’ legal counsel changed the Petitioners’ identity from two individual legislative candidates to the Aceh Party. The nine constitutional justices presided over the ruling hearing in the plenary courtroom on Tuesday, May 21, 2024.

According to the Court, the main issue raised by the Petitioner was not the issue of vote acquisition of individual legislative candidates within the internal political party, as it should be the case in a petition filed by an individual. Instead, the Petitioner challenged the vote count between political parties, i.e. the Aceh Party (Petitioner) and PPP (United Development Party). The Petitioner also did not challenge the results of the party’s vote count as it accepted that determined by the Respondent. In addition, the Petitioner requested the Court to overturn the KPU’s a quo decree.

According to the Court, the Petitioner was inconsistent in identifying itself in the petition, which made the a quo petition inconsistent. Any change of identity in the petition is a major change.

“[The Court] adjudicated, relating to exceptions: to grant the exceptions by the Respondent’s and Relevant Party’s exceptions on the obscurity of the a quo petition, to reject the Respondent’s and Relevant Party’s exceptions for the rest and remainder; relating to the subject matter: to declare the Petitioner’s petition inadmissible,” Said Chief Justice Suhartoyo
