Justices Consider Hanura Party's Petition for Tangerang City 5 Vague

JAKARTA (MKRI) — The Constitutional Court (MK) decided the 2024 legislative election results of Banten Province, in the electoral district of South Tangerang City 5, which was filed by the People’s Conscience Party (Hanura), inadmissible. The ruling hearing No. 64-02-10-16/PHPU.DPR-DPRD-XXII/2024  was held on Tuesday, May 21, 2024 in the plenary courtroom.

“[The Court] adjudicated, relating to the petition’s subject matter, to rule that the Petitioner’s petition is inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices.

In its legal considerations, delivered by Constitutional Justice M. Guntur Hamzah, the Court stated that the Petitioner’s petition contained discrepancies between the posita and petitum, also there was no clear and adequate description in the posita, and did not contain the vote counting error stipulated by the Respondent and the correct vote acquisition results according to the Petitioner. Furthermore, the petition did not request the cancellation of the vote results stipulated by the Respondent nor the establishment of the vote results according to the Petitioner's version. Consequently, the Court declared the Petitioner's petition vague.

Previously, the Petitioner argued that the content of the KPU (General Elections Commission) Decree No. 360 of 2024, specifically on the results of the DPRD (Regional Legislative Council) election in Tangerang City for South Tangerang 5, was legally flawed from the very beginning. This is because it was based on a legal document that also contained a significant legal flaw: a decree of the South Tangerang City KPU made and issued without a legal basis in the context of Law No. 7 of 2017 regarding General Elections. Therefore, the Petitioner requests that the Court cancel either the South Tangerang City KPU Decree No. 287 of 2024 or the KPU Decree No. 360 of 2024 concerning the certification of the 2024 DPR (House of Representatives) and DPRD election results in South Tangerang 5.24 DPR (House of Representatives) and DPRD election results in South Tangerang 5.
