Gerindra’s Petition for Papua 5 DPRD Missed Deadline

JAKARTA (MKRI) — The Constitutional Court (MK) dismissed a petition for the 2024 DPRD (Regional Legislative Council) election results dispute for case No. 181-02-02-33/PHPU.DPR-DPRD-XXII/2024. The case petitioned by Robert Ortisan Rumi, a DPRD candidate for the electoral district (dapil) of Papua Province 5 from the Great Movement Party (Gerindra), was filed past the deadline.

“Relating to the petition’s subject matter, [the Court] declares the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo at the ruling hearing in the plenary courtroom on Tuesday, May 21, 2024.

Delivering the Court’s opinion, Constitutional Justice Arsul Sani explained that the Petitioner's petition was submitted on April 22 at 11.59 WIB, so it had passed the deadline as stipulated in Article 74 paragraph (3) of the Constitutional Court Law, Article 474 paragraph (2) of the Election Law, Article 7 paragraph (1) of the Constitutional Court Regulation No. 2 of 2023, the KPU (General Elections Commission) Decree No. 360 of 2024 on the certification of the 2024 legislative election results announced on March 20, 2024 at 22:19 WIB. Thus, the 3x24-hour deadline ended on March 23 at 22:19 WIB.

“There is no doubt for the Court to declare that the Petitioner's petition has passed the deadline for submitting the petition,” said Justice Arsul. Thus, the Court granted the Respondent’s (KPU) exception regarding the petition being submitted after the deadline determined by the regulations.

In the petition, the Petitioner alleged there had been a reduction in his vote calculation in Mamberamo Raya Regency carried out by the Respondent as stated in the regency’s D-result form. His votes should have been 4,168 in electoral district 5, but 2,523 votes were transferred to another legislative candidate from another party.

The Petitioner reported that 500 votes were transferred to the National Democratic Party (NasDem) candidate Yakobus Britay and 2,023 votes to Democratic Party candidate Keven Tatouw in the Papua Province DPRD election for electoral district 5, Mamberamo Raya Regency. He requested the Court to annul the KPU Decree No. 360 of 2024 on the certification of the results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) election announced nationally on March 20 at 22:19 WIB as it pertains 21 polling stations in six villages in Rufaer Subdistrict, electoral district 5 of Mamberamo Raya Regency. Additionally, he asked the Court to recount the votes for Papua Province DPRD in electoral district 5 as follows: Robert Ortisan Rumi with 4,168 votes. Alternatively, the Petitioner requested a special revote at all polling stations in Rufaer Subdistrict, Mamberamo Raya Regency, for the electoral district of Papua 5.
