JAKARTA (MKRI) — The Constitutional Court (MK) ruled case No. 56-01-07-33/PHPU.DPR-DPRD-XXII/2024 on the legislative election results dispute (PHPU) in Sarmi Regency electoral district 1 in Papua Province inadmissible. According to the Court, the Indonesian People’s Wave Party (Gelora) as the Petitioner was inconsistent in elaborating posita and petitum, where it placed last and not gaining any seat in the Sarni Regency DPRD.
“Relating to the petition’s subject matter, [the Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo at a ruling hearing in the plenary courtroom on Tuesday, May 21, 2024.
Deputy Chief Justice Saldi Isra explained that, in both the posita and petitum, the Petitioner’s argument on the National Mandate Party’s (PAN) vote acquisition as Relevant Party, was inconsistent, thus the a quo petition was unclear.
Based on these legal facts, the Petitioner’s petition did not meet the formal requirements. Therefore, the Respondent’s and Relevant Party’s exceptions regarding the unclear nature of the petition were legally justified and the Court did not further consider the substance of the Petitioner’s petition.

In its petition, the Petitioner (Gelora) stated that based on the copy of C-result form, it received 533 votes, while the Respondent determined that it received 532 votes. This one-vote difference disadvantaged the Petitioner, when it should have been ranked seventh and obtained the last seat in the Sarmi Regency DPRD electoral district 1. Meanwhile, there were additional votes for PAN by five votes and the Democratic Party by six votes. The Petitioner filed a complaint to the Papua Province Bawaslu (Elections Supervisory Body) and it was confirmed by the KPU that they had committed administrative violations. In the petition, the Petitioner requested the Court determine the vote acquisition results for Sarmi Regency DPRD electoral district 1 as follows: the Crescent Star Party (PBB) had 1,108 votes; the National Democratic Party (NasDem) had 822 votes; the National Awakening Party (PKB) had 717 votes; the Prosperous Justice Party (PKS) had 661 votes; the Indonesian Democratic Party of Struggle (PDI-P) had 590 votes; Gelora had 533 votes; and PAN had 529 votes.
