JAKARTA (MKRI) - The Constitutional Court (MKRI) read out the excerpt of the Decree for case No. 129-01-14-33/PHPU.DPR-DPRD-XXII/2024 on the 2024 DPRP/DPRK (the Papuan People’s Representatives’ Council/the Regency/City Legislative Council) for several electoral districts of Papua Province petitioned by the Democratic Party. The Court declared that the Petitioner’s petition on DPRP election for Papua Provinces 1 and 5, DPRK election for Kepulauan Yapen Regency 4 and Jayapura City 3 inadmissible. However, the petition regarding the DPRK election for Kepulauan Yapen Regency 1 will continue to be processed.
“[The Court] adjudicated, before issuing a final decision, to declare the Petitioner’s petition on DPRP election for Papua Provinces 1 and 5, DPRK election for Kepulauan Yapen Regency 4 and Jayapura City 3 inadmissible,” said Chief Justice Suhartoyo at the plenary courtroom on Tuesday, May 21, 2024..
In the Court's consideration, Constitutional Justice Saldi Isra explained that the Petitioner's petition on DPRP election for Papua Provinces 1 and 5, DPRK election for Jayapura City 3 contained incompatible posita or reasons for the petition and petitum; while the DPRK election for Kepulauan Yapen Regency 4 contained obscureness in the Petitioner's posita because it was not described at which polling station (TPS) the Petitioner lost his vote. Thus, the case a quo in the electoral districts above does not meet the formal requirements of the election dispute petition, so it must be declared obscure.
“With the issuance of the excerpt of the decree, the case a quo in DPRP for Papua Provinces 1 and 5, DPRK for Kepulauan Yapen Regency 4 and Jayapura City 3 are not continued to the evidentiary hearing,” said Constitutional Justice Saldi.
Proceed to Evidentiary Hearing
However, Constitutional Justice Saldi added, the Petitioner's petition regarding the DPRK election for Kepulauan Yapen Regency 1 which is also contained in the petition a quo will be continued in the examination hearing with the agenda of evidence.
Previously, the Petitioner submitted a number of petitions based on disputes in the five electoral districts mentioned above. The Petitioner requested the Court to annul General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 legislative election results of the DPR (House of Representatives), DPD (Regional Representatives Council), and Provincial and Regency/City DPRD (Regional Legislative Council) nationally in electoral districts petitioned in Election Results Dispute. In the DPRK election for Kepulauan Yapen Regency 1, the Petitioner requested the Court to certify the correct vote acquisition for the Democratic Party was 1,280 votes.
