JAKARTA (MKRI) — The Constitutional Court (MK) delivered Decree No. 01-36/PHPU.DPD-XXII/2024 regarding the 2024 DPD (Regional Representatives Council) election results dispute petitioned by Shania Moningga Hindom, a DPD candidate of the electoral district of South Papua. The ruling hearing was presided over by all nine constitutional justices on Tuesday, May 21, 2024 in the plenary courtroom.
In its legal considerations, the Court stated that the General Elections Commission (KPU) announced the results of the DPD election through Decree No. 360 of 2024 on the certification of the 2024 legislative election results nationwide on March 20, 2024 at 22:19 WIB. Thus, 3x24 hour-deadline from the announcement was March 23, 2024 at the same time.
Meanwhile, the Petitioner filed the petition to the Court on March 23 at 22:29 WIB based on the deed of electronic petition filing certificate (e-AP3) No. 12-36/AP3-DPD/Pan.MK/03/2024 dated March 24. Thus, the Petitioner’s petition was submitted past the deadline as determined by statutory laws and regulations.
At the previous hearing, the Petitioner filed the petition against the determination of the election results by the Respondent to the Constitutional Court on March 23, 2024, with the AP3 dated March 24, 2024. Thus, the petition had passed the deadline specified by statutory law. Therefore, the Petitioner’s legal standing, the Respondent’s objection, and the subject matter of the petition were not considered further;
“[The Court] rules to declare the Petitioner’s petition inadmissible,” said Chief Justice Suhartoyo.
