Court Dismisses PKS Candidate's Petition for Central Papua

JAKARTA, MKRI — The Constitutional Court (MK) rules to declare the petition of Yerry Miagoni, a candidate for Central Papua Provincial the Regional Legislative Council (DPRD) member from the Prosperous Justice Party (PKS), inadmissible. The Panel of Constitutional Justice stated that Case No. 159-02-08-36/PHPU.DPR-DPRD-XXII/2024 did not meet the formal requirements of the petition because it did not have legal standing to file a petition. The rulling hearing was held on Tuesday, May 21, 2024 in the Plenary Courtroom.

[The Court] in the exception, grants the respondent's exception regarding the petition is obscure or vague, reject the respondent's exception for others. In the main case, the petition must be declared inadmissible,” said Chief Justice Suhartoyo alongside the other eight constitutional justices. 

The Court stated that the Petitioner did not attach a letter of approval from the relevant political party to apply as an individual legislative candidate. After examining the Petitioner's petition file received along with evidence based on the Deed of Electronic Petition Submission (e-AP3), the Court found that the Petitioner only attached a letter of recommendation from the Branch Leadership Council of the Prosperous Justice Party of Central Papua Province, without approval signed by the General Chairman and Secretary General of the Central Executive Board (DPP) of the Prosperous Justice Party.

Previously, the Petitioner argued that there was a difference in votes between the election results determined by the Respondent KPU (General Election Commission) and the correct election results according to the Petitioner. According to the Petitioner through his legal counsel, Regio Alfala Rayandra, the Petitioner's vote should have been 14,870 votes, but according to the results determined by the Respondent, the petitioner's vote was zero.(*)
